This is an interesting PERC case. Basically, Gregory Potter was dismissed by the agency but appealed to PERC and in settlement negations agreed to resign. Look at the signature for "Director of the Highway Patrol" In place of the Colonel, it is signed by an Acting Director which in itself isn't all that unusual. Hildreth and Duarte have been acting Director at various times and have signed documents as such. In this case, though, the signature looks like "Richard Creamer"....since when can a civilian be acting director of a law enforcement agency? If the Colonel and both Lt. Colonels were not available it seems that Brown could have stepped in.
There is no requirement in Florida Law for the director of a state law enforcement agency to be a law enforcement officer under Chapter 943. The high sheriff doesn't even have to be a LEO. Welcome to Florida.
You're right. There's no statute requiring the director to be a certified law enforcement officer. I guess my question is why would the Colonel cede control and command authority of one of the largest law enforcement agencies in the State to a civilian? Even giving to one of the GHQ Majors would have more sense than the "Chief Administrative Officer" who has no law enforcement experience. Although it does make sense in the fact that Creamer was sent to the Criminal Justice Chief Executive Seminar....so being Acting Director is a good use of the skills he learned at the CJCES!
You guys are top 10 in the state but not one of the biggest by far.

    Miami-Dade 4700+
    Jacksonville 3200
    Palm Beach 4000+
    Hillsborough 2000+
    Orange County 2000ish
    Pinellas County 2700
    Broward County 3100
Even with the merger you guys have about 1750ish troopers. Remeber all the vacant positions they got rid of several years back, it was about 200 statewide.
