    [/qthere should be legislation passed that limits an officer's death benefits to a 50% reduction if the officer elects not to wear a department issued vest regardless if the vest was a contributing factor in the officer’s demise. This would be similar to the current tort law that reduces the payout of individuals who are injured as a result of an auto crash and were not wearing a seat belt at the time of the crash. In this particular case the medical examiner has determined if this officer was wearing his departmental vest he would not have died from the gunshots to the chest and abdominal area.
