    IUPA

    $$$$ WANT MORE MONEY $$$$

The city*MUST*allow a*NEW*bargaining unit (IUPA Lawyers) to renegotiate the contract. The city CANNOT give us anything LESS than the current contract.***To reiterate: IUPA uses*expert labor union attorneys*to negotiate our contracts**

    *

    ADVANTAGES:

Ø**IUPA DOES NOT have any direct ties to City Council OR Administration!! IUPA is working for our best interest and NOT the interest of the Administration*

Ø**Currently in an IA?? Well, IUPA will take on the responsibility of representing you, regardless if the incident occurred prior to the IUPA transition. HOWEVER, if you’re involved in any legal investigation (civil lawsuit/criminal investigation), then the PBA is still REQUIRED to represent you! **You’ll never go without representation**

Ø**Choice of a lawyer during legal matters. (NO FINANCIAL CAP)

Ø**IUPA provided financial backing to the republican party, President Trump (2016 & 2020)

Ø**Any affiliations and endorsements, if any, are solely decided by the collective agreement of the members (AFL-CIO, etc.)

Ø**IUPA is currently lobbying to preserve Qualified Immunity for law enforcement

    *

    The New IUPA Board

Ø**An election will be held to determine board members

    Ø**Includes ONLY*employed*personnel from the agency*

Ø**Will include at least one person from communications

Ø**No hidden agendas or personal relationships with administration

Ø**Board members fighting for the needs of all members and not just certain units

Ø**Putting the power back into the members and ELIMINATING board members doing only what they think is best*

Ø**All about TRANSPARANCY!! All meetings will be recorded and accessible on YouTube

Ø**Representing the Majority. The board will utilize surveys and votes to determine what the MAJORITY wants*

    *

Provided on page 3 will be complete answers to Officer Joe’s Questions.**

    PBA

    Contract

Ø**Failed to fully disclose the adverse changes

    Ø**Sick leave*ONLY*for members in your*HOUSEHOLD

Ø**Sick leave abuse – determined by department head (if they deem it abuse-*NO PAY)

Ø**Call-offs MUST be made 2-hours prior to your scheduled shift instead of the previous contract with no requirement*

Ø**The Step-plan should never be negotiated

Ø**Lowered the testing requirements for promotions. We should NEVER lower standards. Also, it’s no longer mandatory to select from the eligible list.*

Ø**Instead of the 3-hour minimum for work assignments while off duty it’s been limited to 15-minute increments.**

    *

    Past Contracts

    Ø**Reduction of cost of living

    Ø**Reduction in the pension multiplier*

Ø**Reduction of insurance benefit (From $290 to $150)

Ø**Reduction in Night differential (From 5% to $80)*

    *

    Important Questions and Comments

Ø**Why would the PBA grieve the promotional process and then change the wording in the newest contract? (It undermines the grievance)

Ø**Why does Matt, and the board members, make decisions without our input?

Ø**Why don’t we have more meetings?

Ø**Shouldn’t Mike Walsh be the president if Matt steps down? In this event, don’t WE vote for the president?

Ø**Why is the PBA filing lawsuits AGAINST PBA members? Having fellow officers, and PBA members, turn on each other for a lawsuit!

Ø**Why are PBA board members allowed to solicit for the PBA ON DUTY, while IUPA must abide by labor laws?

Ø**Matt and another board member allowed officers and supervisors to influence and intimidate members during voting!*

    Officer Joe’s answers next

    Questions and Answers

How much are the monthly dues?

IUPA’s monthly dues are $45.00 ($6.50 difference from PBA). With IUPA, we have an attorney negotiating our contracts. Our IUPA Local also has the option to raise the dues to $50.00 and receive a $5.00 rebate to be utilized for anything that OUR membership deems necessary, such as campaigning, charity, events, etc.

    *

Can you please provide your policy that determines when an officer receives legal coverage, and the officer does not? When is an officer provided with an attorney?

IUPA members will be provided with a New Member Packet, and inside the packet will be a 1-800 Emergency Response number that operates 24/7, 356. If you are involved in a critical incident*that occurs during the scope of our duties, such as Officer Involved Shootings, In-Custody Deaths, Use of Force Issues, and Traffic Accidents, call the 1-800 number, and an attorney will respond on scene within the hour. IUPA has a premier Legal Protection Program with over $51 million in reserves. If you are charged with a crime or sued civilly, IUPA members will be provided with an attorney from start to finish. There are*NO Caps, NO Co-pays, and NO Deductibles.*If needed, our plan also includes Expert Witnesses to testify in court on your behalf and Investigators to gather additional information. Additionally, if multiple officers are involved in one incident, the IUPA’s Legal Protection Program provides*EACH*officer with their own attorney instead of one attorney collectively.**

    *

Will legal coverage cover an officer when incidents predate their*membership?

Yes, IUPA will take overall investigations or complaints that members are involved in prior to the change. However, if a criminal or civil case is brought against a member before the transition to IUPA, the PBA would be the one to take the case due to the incident occurring while the member was under the PBA’s membership.

    *

Will you be honoring the current contract, or will you retract it and return to the bargaining table?

IUPA has the option to keep your newly ratified contract or go back to the table and negotiate to improve our current contract. Either keep what we have or go back and negotiate for improvements! It’s up to us, the members, to vote!*

    *

Please provide your by-laws that would govern our unit.

IUPA does not establish our by-laws. IUPA provides our board members with a template, and we as members decide and vote on our by-laws. IUPA will assist us with an origination structure and give any information to complete the transfer.

    *

Do you have*Sworn Law Enforcement experience?

    Yes.

    *

I am being told that PBA has filed interest cards recently in Broward County SO to oust IUPA, is that correct?*

Yes, the PBA has filed interest cards; however, last month, the Broward PBA lost its largest unit, Hollywood Police Department, to the FOP, so it’s highly unlikely that Broward County will switch to the PBA. It should be noted that there are PBA supporters in any organization; however, IUPA has spoken to the president of Broward County, and they are confident that they will not be leaving IUPA. PBA has filed cards on every contract, repeatedly failing every time. The last vote was IUPA=677 PBA=114.

    *

IUPA has experienced unprecedented growth over the last several years, and below are the departments that have voted to switch from PBA to IUPA and have not looked back!*

    *

South Daytona PD,*Port Orange PD,*Port Saint Lucie PD Officers, Port Saint Lucie Sgt's, Port Saint Lucie Lt's, Saint Lucie County Sheriff's Office, Indian River County Sheriff's Office Road Deputies, Indian River County Sheriff, Office Correction Officers, Indian River Shores PD, Vero Beach PD, Hallandale Beach PD, Broward Sheriff's Office, Sarasota PD Officers & Sgt's, Sarasota PD Lt's, and Volusia County Sheriff's Office - Their union at the time was Teamsters and PBA was on the ballot with IUPA.*PBA only received 31 votes, IUPA 229, and Teamsters 7.*

    *

How many members does IUPA have in just the state of*Florida?

IUPA has over 112,000 members nationwide, they currently serve 46 other local unions in Florida with a total of 5,814 members within those unions.

    *

What Florida legislation has IUPA authored and/or lobbied for?* What is IUPA's list of Florida legislative accomplishments?

They have lobbied for the FRS and retirements. IUPA is also working on the federal level and is currently fighting against them taking away qualified immunity. (You can go to*www.IUPA.org*if you would like additional information on this question)

    *

    Final remarks:

It should be noted that IUPA utilizes labor union attorneys that conduct staffing studies and comparisons to national and local agencies for wages, and they come to the city council and present the data.*

Additionally, IUPA retains lawyers to cover the areas of expertise needed. If a member is involved in a criminal incident, the member will have a criminal attorney retained, not a civil or labor attorney. If the member is involved in a civil case, they will have a civil attorney representing them, not a criminal attorney. Members can also retain their own lawyer; however, they have to meet the standards set by IUPA to make sure that the member’s best interest is covered.

IUPA utilizes local attorneys such as Aiken & O’Holloran*https://www.aikenohalloran.com/. Once the transition is made to IUPA, Ringsmuth, Day & O’Halloran*RINGSMUTH, DAY & O’HALLORAN, PLLC. | Fort Myers, FL Criminal Lawyers*will be asked to join the IUPA legal Team.*
