    Because the deputy is in one car and the driver in the other, the deputy cannot see exactly what the driver is using his phone to do.

    According to the law, the driver does not have to surrender his phone to an officer — which means the deputy cannot establish that a violation of the law occurred.

    Every cop already knows this. This law is a typical politician move just to say they support something without really having too. Public safety be damned. Texting should be illegal as a primary, so should cell phone use without hands free. The legislature should all be required to provide clear guidelines and not this fluff. I guess I am expecting alot since most are lawyers. LOL

    and I will never pull someone over for this because only the honest people will get jammed up.
