As the trial began, prosecutors said that former Sarasota Sheriff’s Deputy Frank Eugene Bybee abused his power as an authority figure to gain the trust of a 79-year-old Sarasota woman and then attempted to kill her after she reported him to superiors.

The Herald-Tribune will not name or photograph the alleged victim.

Bybee, 46, is charged with 18 felonies, including attempted murder, exploitation of the elderly, burglary, theft and kidnapping. A conviction of the alleged crimes carry a maximum sentence of life in prison.

The alleged victim reported that Bybee came over uninvited and attempted to strangle her, smother her with a pillow, make her take pills, and then later, after she fell asleep, he reportedly left the kitchen door to the garage open with a car running to asphyxiate her with carbon monoxide.

Attorney Ronald Kurpiers said that blood, cuts and bruises were not present when deputies first arrived at the victim’s home to investigate her claim. “Not one deputy filed a report that there was carbon monoxide in that house,” Kurpiers said. “They saw a distraught woman sitting in a recliner. The only thing wrong with her is that she has a cut lip — according to five experienced deputies.”

The victim called the Sarasota Sheriff’s Office a second time at around noon and a sergeant and a detective were sent to the home, according to Kurpiers. He said they discovered the victim was now in a bruised and bloody condition. “Totally different,” Kurpiers said.

The identity of the alleged victim, Ms. Marcia Sohl, is provided in the narrative because:
1. it is public record
2. her name is being actively reported by WFLA, SNN and other news outlets
3. it aides in understanding the case.

[Ms. Marcia Sohl] said Bybeee came to her house “to kill me” — something she repeated several times during her testimony.

Sarasota Sheriff’s Sgt. Jonathan Allen testified that [Sohl] claimed that Bybee tried to kill her and then carefully cleaned up the scene. Allen said [Sohl] made statements that Bybee was wearing blue gloves and that “[the investigator] would not be able to find any evidence because Bybee was thorough.”

Allen said [Sohl’s] injuries did not support a two-hour struggle, as [Sohl] claimed in her testimony. Allen said he saw no sign that [Sohl] was choked. Allen said, “I believed it was a mental health situation and…”
