    Re: The Unwelcomed Witness

Stephen Benenati of New York isn't the kind of guy you'd figure to be a witness to foul play in the Cohen murder. But he's got testimony, SSO powers-that-be don't want to hear and don't want you to hear. This Board's cacophonic harangue bears boisterous witness.

And so this is the untold story of a cast of characters, antagonists & protagonists pertinent to Murray Cohen's murder: 911's retired Ann Barrett, Maria Amurrio, Officer Bell, Detective Halisey, Detective Scott, Witness Stephen Benenati, Witness Tracey Weeks, Audio Expert Paul Ginsburg, plus Specialists James Casey & Gary Ferguson.

Quoting from Detective Chris Hallisey’s Synopsis of 3/4/2004:
“According to Det. Scott’s report[,] the decedent was taking an afternoon nap (1630) with Maria when the phone rang. Maria answered the phone and the caller asked for the decedent to come to the telephone. When the Decedent did not respond, Maria went to check on him only to find him unresponsive. Maria hung up with the caller and called 911.”

Quoting from Maria Amurrio Cohen’s video deposition of 8/6/2003, which was in the hands of Detective Hallisey when he wrote his report, at Page 63 -- she testifies: “I asked the person [on the phone] if it was an urgent call and he said, yes, he had an appointment over the phone with my husband and there is a clock right in front of me and I look at it, and it was 5:38.“

According to the caller in a sworn statement dated 11/24/2003, Stephen Benenati, First Vice President-Investments, Senior Investment Management Specialist of Smith Barney, said: “The first time I called I introduced myself, asked to speak to Murray Cohen, and recollected that I heard screaming on the part of the woman ... who picked up the phone, and a male voice screaming in the background. The phone was abruptly dropped on the floor...The phone set was then picked up, and I said hello, and identified myself again. There was no answer, and I hung up. I thought that I might have called the wrong number, so I called again. The next call was made about 2 minutes later, after I checked the number. It was answered by someone with the same woman's voice from the first call. She was still sobbing. I introduced myself again, and advised her that I had a scheduled conference call with Murray. While she was sobbing she said that Murray could not get to the phone, and then abruptly hung up. While she was speaking to me, I also heard the same male voice, hysterical[ly] screaming in the background. I then asked the women if everything was OK, and she said nothing and hung up.”

17 minutes separated this version of the time line from the real one that started at 5:58 PM, and Detective Hallisey was determined to close the time lines. Reporter Doug Smith picks up the story.

If Amurrio's testimony were truthful, Murray took a nap at 4:30 PM but never woke up. Tracy Weeks, Murray's next door neighbor, however, saw him getting his mail at 5:15 PM. And Stephen Benenati heard a loud domestic quarrel, in which he described Murray's voice as hysterical well before Amurrio picked up the phone to call 911. Murray's voice would diminish to hardly audible and end with a gurgle as the Corozal, Indocin & Percodan worked their lethal effect, aided by Amurrio's foot, as she stomped the air out of his lungs. Yes, he was found on his stomach -- an unconventional way at best to do mouth-to-mouth, lividity developing her foot prints.

Amurrio waited till 5:58 PM, figuring from his blue face and reclining posture that he was, as she said, "totally gone." She was wrong. Murray rallied.

As audio expert Paul Ginsburg put it: "Yes, I heard a dead man talking." But who are these witnesses and audio experts anyway?

James Casey headed the Jacksonville FBI headquarters until retirement in 2012, when he went into private practice. Mr. Casey was in charge of 250 agents and task force members who conducted all FBI investigations in 40 counties in Northern Florida.

In private practice, he was retained to research the Murray Cohen case. After a meticulous investigation, Mr. Casey concluded, there is probable cause that Amurrio caused his death, adding that law enforcement blundered investigating the true cause of Murray Cohen’s death.

But who is James Casey anyway? Or retired SSO Homicide Investigator Gary Ferguson, who surveyed the confined crime scene, where he opined it was impossible to do CPR, then expressed the belief that this was a cold-blooded murder done for money & greed? Let's trash Gary too!

    Angry Burying the Evidence

    [attachment=0:3ii03x81]Detective Chris Hallisey.jpg[/attachment:3ii03x81]

Report of James Casey, Head of the Jacksonville FBI Office, now retired:
“Based on my training and experience, as well as my nearly seven-month investigation concerning the death of Murray B. Cohen, I have concluded that there is probable cause to believe Maria A. Cohen caused the death of Mr. Cohen for the purpose of obtaining his assets, and that the facts in this matter should have been brought to a grand jury or a coroner’s inquest shortly after they were discovered for further consideration."
    • James Casey Report (Jan. 23, 2013), head of the Jacksonville FBI headquarters until retirement in 2012, was in charge of 250 agents and task force members who conducted all FBI investigations in 40 counties in Northern Florida.

How many, more, SSO officials involved in gerrymandering the Cohen case must bite the dust before their dishonesty is recognized in the affair? Case in point: Detective Chris Hallisey, who picked up the case from Detective David Scott around July 8, 2003.

In his report, Scott wrote: “1/15/03 1320 hours I requested a copy of the 911 call made by the complainant and placed it in property.” Not so. Scott, who was later promoted to Lieutenant, didn’t place the recording in property, according to Bonnie Brinson, Records Custodian, until sometime in June, 2003. What tricks was he playing in the meantime?

Given different analog versions of the same recording, along with audible, transient thuds, the sabotage had to have been inflicted on Scott's watch. All calls on January 13, 2003 were deleted from the Freedom Drive while every thing else was present, digital copies were destroyed and the disk was sent packing at a time when outside interest focused on it. No question, Major Kurt Hoffman conspired in the cover-up, because several of us saw him in action and there's a record he left behind. Who else conspired is an open question.

When Steve Esdale told Scott that he could hear his Father's voice (confirmed since by all audio experts), Scott fumed: “You are hearing things and you need to move on with your life. Never call me again.”

Then Major Gooding assigned the case to Detective Hallisey, who started by assuring Esdale that the 911 recording was already in the process of FBI analysis. But when questioned at the end of August, Hallisey said SSO didn’t need FBI analysis; they had done it all on their own. [What they had done is destroy the recording!] And when Hallisey did send the recording to the FBI, surprisingly, he sent the most degraded, analog copy.

According to the official record, Chris Halisey met with SAS Andrew Rose of FDLE on September 15, 2005. Hallisey was quick to report to FDLE that the FBI enhanced the tape and reported that there were “low level voices of unknown origin” which were “consistent with cross talk from adjacent channels,” as well as other voices being “caused by the sound from a radio or TV broadcast at the 911 Center or in the background at the caller’s end.” Detective Hallisey explained that 911 operators wore headsets with boom microphones, which he said could have recorded background voices in the call center. All wrong, and we’re about to tell you why.

According to an SSO insider: “The lead detective from the SSO, Chris Hallisey, made huge errors during his investigation. He has since been fired for doctor shopping [when] he became addicted to pain pills. If he had any honor he would come forward and tell everyone what he did and why he did it.”

The SSO insider went on: “The SSO has never been held accountable for this botched investigation and they have made a pattern of blaming M. Cohen's son (who has called them out publicly for their mistakes) crazy and paranoid. [After SSO complained to Amurrio that the agency had too much with which to deal, Amurrio started the "crazy and paranoid" routine.] They have excused their behavior by blaming the victims son.”

“Many at the SSO know the truth,” this insider said. “Chris, if you read this, you should be ashamed of yourself. Quit blaming Steve Esdale and admit you missed the Corazol connection. If this was your dad or brother, you would have never given up either. Do the right thing now!”

So the cover-up goes from Amurrio to lover Bell on up, down and across the board. And when the rhetoric gets too hot and heavy, Amurrio comes in here defending herself, labeling both Esdale and me crazy. One telling discussion we've had on Leo was Amurrio's treatise on poisoning. Sometimes she tasks Officer Bell to post in her behalf.

William Tidwell’s name is studded with impressive intitials: A+, MCP, MCP+I, MCSE. Bill is a former employee of Dictaphone Corporation, the manufacturer of the Dictaphone Freedom System that was installed in the County’s Call Center at the time of Murray’s murder. Tidwell was, in fact, the Primary Engineer for the call center until Feburary, 2003, and he refutes everything material to the Cohen Murder that Hallisey told FDLE.

Hallisey’s description of “low level voices of unknown origin” which were “consistent with cross talk from adjacent channels,” as well as other voices being “caused by the sound from a radio or TV broadcast at the 911 Center or in the background at the caller’s end,” shows no understanding of how the call Center is configured, Tidwell wrote in his Affidavit dated January 21, 2006.

Says Tidwell under oath: “Calls that come in to the 911 call center are recorded digitally. Digital lines do not generate crosstalk; therefore, crosstalk must be eliminated as a possible source of voices that can be heard in the background of the 911 call in question. Further, the televisions at the call center are configured to broadcast in the closed caption mode. As such, they do not generate audible signal that can be picked up by the microphones in the call takers’ headsets. Moreover, a signal generated from a radio or television broadcast would be heard consistently throughout the 911 call, not intermittently, as are the voices in the background of the 911 call placed by Maria Cohen and answered by 911 dispatcher Ann Barrett on January 13, 2003.”

Bill Tidwell completely contradicts Hallisey’s sorry part in the Cohen affair, adding another crucial fact: Since the 911 headsets were voice activated (VOX), “low level voices” wouldn’t be picked up. A sound level that would trigger a VOX was not permitted at the call center. Detective Hallisey worked side by side with 911 and would have known all this.

Hallisey's portrayal, rather, appears to be a a high wire act to purposely furnish the FBI the most degraded copy of the 911 recording -- in the analog domain no less, then parrot FBI findings that would be viewed authoritatively yet, in truth, were contrary to fact.

In judging Hallisey's integrity, the question resolves down to how much did he really know about the Cohen murder and when did he know it? The following document about Hallisey's contact with witness Stephen Beninati, who heard the hysterical argument between Maria and Murray twice over the phone around 5:35 PM, answers that question. Remember, by this time Amurrio had told investigator Scott, whose file Hallisey adopted en toto, Murray had been long "totally gone" & "not breathing." Go to: http://cohenmurder.com/uploads/Polygraph_SSO.pdf

For evidence of Amurrio's bogus story starting the timeline at around 6 PM, please see: http://cohenmurder.com/uploads/Police_Report0002.pdf.

Beninati's calls to Murray came in at around 5:35 PM, 23 minutes prior to the time Amurrio reported them to SSO in the subject report. Amurrio readily contradicts her own timeline. Not only did Hallisey have the official SSO report with the timeline starting at 5:58 PM, but he also had Detective Scott's contradictory report where she stated she found her husband dead at 4:30 PM or thereabouts: "1/13/03 1930 hours ... I questioned the complainant. She advised that she found her husband on the bed, and his skin was purple. She called 911 and moved him to the floor to attempt CPR, however she was unable to revive him. she advised that he must have died in his sleep."

Amurrio told SSO that she placed a call to friend, Ronni Rose, at 5:40 P.M., seeking medical advice, but never reached her. Rose was Murray's previous girlfriend who had introduced him to Amurrio. Why Amurrio called Rose and not 911 is a mystery, because Amurrio knew for sure, Rose could give her no medical advice. Amurrio was the one educated in nursing & narcotics with a general knowledge of medicine that Rose simply didn't have.

So the call bolsters suspicion of some understanding they might had had ahead of time. Rose reported that the message she got was to the effect that Murray was having a heart attack. She wasn't sure whether Amurrio had placed the call before or after the heart attack, leaving his time of death doubtful to her. Later, Rose would be seen accompanying Amurrio, when she tried short-changing Sarasota's Able-Band Law Firm & represented herself. Rose was seen taking an active role consulting with Amurrio during these court appearances. No investigation has ever been done into Rose's potential role in the Cohen odyssey. For example, has any significant money passed from Amurrio to Rose since Murray's death?

This direct evidence presents a timeline 20 minutes earlier than the real one documented by the 911 call at 5:58 PM.
Instead of blowing the whistle, Hallisey was bent on reconciling these two timelines -- an exercise in reconciling the irreconcilable. Superlative, TV Journalist Doug Smith picks up the story:
    http://www.youtube.com/watch?v=kyyk-PIbu-o

Every now and then a super-nova comes over a courtroom. For Steve Esdale, that day came in Sarasota Circuit Court on November 4, 2004, when he was able to examine Chris Hallisey. Anyone rooting for justice will appreciate this repartee:

    Q. Detective Hallisey, in your report here, when you referred to the first time that you had sent out the package with the tape to the FBI, was there a report generated?

    A. Not on the first or the second submission, no.

    Q. So you submitted evidence to the FBI how many times?

    A. Three times.

    Q. Three times. And how many reports are there?

    A. One.

    Q. So it’s your testimony that the first two submissions had no report?

    A. Correct.

DETECTIVE HALLISEY: And if I can be allowed to elaborate to the Court, I certainly would be willing to explain what happened.

    THE COURT: Sure.

DETECTIVE HALLISEY: The FBI, on the first two submissions, only did an enhancement. Despite what my request was, they only did an enhancement of the tape and sent it back. When I contacted them again and explained to them that we were requesting an analysis of the tape, that is when the final report was done.

    THE COURT: Right.

    Q. Well, my question to you is, if you stated to the Court that the first two times were only to have an enhancement, how did you close the report – how did you shut my father’s murder investigation before you even had a transcript.

    A. That decision was come to by my bosses and myself. We reviewed the evidence. We spoke to the medical examiner’s office. And we determined, at that point, there was not any reason to resubmit the tape.

The transcript explains, pressure of public opinion sparked an actual report from the FBI, but nowhere does Hallisey come clean on the dirty recording he furnished the FBI. His testimony indicates that he submitted only one version of the recording, which we know was a terribly degraded, analog version.

He had the opportunity of taking on the quality issue but apparently considered it a can of worms. Like his life outside law enforcement, Hallisey was content with using the FBI to enhance a noisy, degraded, impossible recording and render an opinion thereon that he could then cite to dash the case.

This failure alone to disclose that call center recordings were made in the digital domain, unlike the analog tape submitted, creates an irreversible error in the FBI analysis. Thus, Hallisey was content with using the imprimatur of the FBI to justify law enforcement's unjustified ballyhooing of conjured-up demerits and dropping the case. Wrote Murray's son Steve,
Detective Hallisey created a false timeline to change the fact that Murray Cohen's stock broker, who had a pre-arranged appointment, was an ear witness to Murray Cohen's murder. Hallisey also created this false timeline to hide the fact that my father suffered for 20 minutes before dying.
In another matter concerning the cover-up's ring leader, Murray's son Steve wrote:
Captain Jeffrey Bell falsified a report dated 3/04/2004, in which he stated that the FBI findings did not concur with my Audio Expert’s findings. Documents show the FBI findings were not reported until 6/26/04. Captain Jeffrey Bell is suspected of being romantically involved with Murray Cohen's killer during the investigation of his death.
Is it any wonder that Steve Esdale wants closure for his family in the Murder of his Dad? Any one of us would feel the same way and, for me, empathy dictates action.

Everywhere you look you find another foul ball, another low blow, another missed opportunity, another untruth. In fact, this case is one big train wreck of fraudulent episodes that amount to a colossal, comprehensive cover-up.

We citizens look forward to the time when SSO powers-that-be display a modicum of integrity and do the right thing. They may not be capable of the kind of integrity they urge on us citizens, but even a trifle of honesty will do. This is not too much to ask of our police!

Thank God, we live in a free country where we can express ourselves. If you want justice in Sarasota County, climb on board. Contact me. Let's make clear and understandable noise together. In America, we, the people, can achieve anything right and good for society.

Let's make a deal, Sheriff Knight

For over a decade my American Florida family has strongly believed members of SSO are responsible for denying our rights to equal justice under law and maliciously violating our guaranteed constitutional rights to life, liberty and the pursuit of happiness.

During the Zimmerman trial I watched the testimony of FBI audio expert Nakasone. Nakasone happens to be the FBI analyst who provided SSO with an examination written report derived from the 911 recording sent to him by SSO. Nakasone testified that in 2012 the FBI audio lab upgraded it's software, methods and protocol for audio analysis.

If you request the FBI audio lab conduct a new examination of the version which has been examined by multiple forensic audio experts around the country, and the new findings do not concur that my father is pleading for ambulance after he was reported to be not speaking, not breathing and totally gone, and that my father's wife of three weeks, Maria Amurrio is not yelling at him to give up, I will be willing to shut down my website and GO AWAY .

What a surprise to see you on here Steve. Now you've given Sheriff Knight an offer no legitimate law officer can refuse. Let's stand by and see what happens.

Sheriff Knight, here's the crux of the case against Amurrio, a great starting point for legitimate law enforcement:

    The Casey Report. http://cohenmurder.com/uploads/Jim_Casey_s_summary.pdfJ

The author, James Casey, headed the Jacksonville FBI headquarters until retirement in 2012, when he went into private practice.

If anyone at any law enforcement agency from the SSO to the FBI believed this was murder, they would jump at the chance for justice, but NO evidence of a crime.
How are you so sure there wasn't a murder? You seem to have a personal ax to grind in this case.

Besides the nation's top audio experts confirming my father pleading for an ambulance after he was reported to be deceased, and the third world Bolivian killer/wife of three weeks yelling at him to give up, the experts also hear my father saying to his Attacker, "You get away from me, you're not going to kill me". She replies, "Too Late and then is heard yelling at him to give up.

Let's forget about the fact that the wife of three weeks pretended to perform CPR and when paramedics arrived, he was face down.

Lets forget about the fact that phone records show the wife of three weeks checking my father's bank account balances as he lay dead on the floor waiting to be picked up by the morgue.

Lets also forget about the fact that a lethal exotic poison was found at the death scene an inventoried by authorities. How are you so certain that my father was not murdered when he did not even have an autopsy performed which is against Florida law?

If the FBI was to confirm all these statements, would it change your position?

Re: Let's make a deal, Sheriff Knight

You did not answer my question so I will ask you one last time. Would you call my father's death a murder if the FBI was to confirm that he said to Amurrio, "You get away from me, you are not going to kill me". Amurrio replied, "Too Late, Give up."

Once again, Sheriff Knight, my offer to shut down my website and go away still stands.

As I promised from the first day that I discovered my father was a victim of a cold blooded murder, I will fight for justice until justice is served. Isn't eleven years of allowing a cold blooded killer to walk the streets long enough?

Cops need proof beyond a reasonable doubt. If anyone at any law enforcement agency from the SSO to the FBI believed this was murder, they would jump at the chance for justice, but NO evidence of a crime.

Remember, contrary to Florida law, there was no autopsy. Oddly, neither was blood work ordered nor analyzed.

For the sake of clarity the Smoking Pistol is an exerpt, repeated 4 times, with two periods of relative silence removed. You can clearly hear Amurrio commanding Murray to "Give Up." Sensitive ears can hear the wwwooosssshhh from Murray's lungs as Amurrio stomped on his back, lividity developing her foot prints. This enhancement, near-NASA technology, took dozens of hours.

What we have from the poster above is a corollary to the following:
FROM NORTH KOREA'S PERSPECTIVEA stunningly beautiful, twenty-something woman dressed in black performs her death wail in the main hall of an obscenely luxurious palace in central Pyongyang....[Her face contorted,] Speaking in a monotone, a guide translates the weeper's words into English: "The departed supreme leader's love [Kim Jong-il] will fill our hearts for eternity …" The voice just keeps going, and in a glass cage in the middle of the room lies the embalmed body of Kim Jong-il. Everyone in the mausoleum bows their heads before the body – or perhaps the wax doll – flanked by North Korean army officers at attention. Anything else would be intolerable and would result in immediate arrest."

The world view from North Korea, similar to the above poster's declaration: No murder. Respected poster, you can hear the murder going down in the 911 recordings [Links above], however much SSO tried to sabotage it.

How can any legitimate law enforcement official turn his back on the overwhelming evidence of Murder One at this probable cause stage? Every crime comes up with some defense, but all we've gotten from the Amurrio forces are general denials, as above, and character assassination. There's got to be an explanation for the two episodes of "Give up" we hear her yelling and the woooshhh, as Amurrio stomped on Murray's back. Who else talks to a "totally gone" victim? Opining there was no murder in the face of all the information presented [please see threads "The Unwelcomed Witness" & "Burying the Evidence"] to the contrary is akin to believing in the cards or alignment of the stars.

The audio is most certainly direct proof of Murder One. And how do you reconcile Amurrio's conflicting testimony on the two timelines? [Please see http://www.youtube.com/watch?v=kyyk-PIb, the respected, retired head of the Jacksonville FBI, James Casey's report: “Based on my training and experience, as well as my nearly seven-month investigation concerning the death of Murray B. Cohen, I have concluded that there is probable cause to believe Maria A. Cohen caused the death of Mr. Cohen for the purpose of obtaining his assets, and that the facts in this matter should have been brought to a grand jury or a coroner’s inquest shortly after they were discovered for further consideration.” [Please see http://cohenmurder.com/uploads/Jim_Casey_s_summary.pdf, former SSO Homicide investigator's express opinion after viewing the crime scene that this was a murder done money [please see Read retired SSO homicide investigator, Gary Ferguson's Affidavit: http://cohenmurder.com/uploads/Ferguson ... nt0001.pdf.

WTVT Link in "Burying the Evidence" Corrected

Sorry gang I had to use an extra thread for this, but Doug Smith's video is indispensable to "Burying the Evidence."

How aghast I was when I found the broken link about two different timelines. Thanks to Leo technology, I was able to correct the post to reflect that very important report. For those of you who missed it, go here: http://www.youtube.com/watch?v=kyyk-PIbu-o
