    Federal Framework Being Set Up To Arrest Sheriffs

    Colorado, and apparently Texas (next) are being targeted with an attempt to set up a federal authority framework that will enable Secret Service agents (not just those guarding the president), and others of the U.S. Secret Service including uniformed division officers, physical security technicians and specialists, and other ‘special officers’, to arrest and remove an elected sheriff for refusing to enforce the law (or anyone breaking the law).

    The bills being introduced defines law as including any rule, regulation, executive order, court order, statute or constitutional provision.

    Come on, Worf, you know this is a total BS story.

    Since the 1960's we have been working state by state to get Peace Officer status for USSS Agents. It has always been a source of frustration to agents, particularly to those who were formerly in law enforcement before becoming agents, that if we observed a violation of state law in our presence (such as armed robbery) the only thing we could do was to make a "citizen's arrest."

    There are presently 43 states in which similar laws have been passed giving USSS agents Peace Officer status. There are several others that don't make that explicit designation but which allow the agents to make arrests for local offenses.

    Several other federal agencies also have peace officer status, including the FBI, DEA, ATF and others.

    This action by Colorado was passed with the full endorsement of Colorado's Police Officer Standards and Training agency.

    This is not a plot to be able to arrest Sheriffs who will not enforce federal laws that they deem contrary to the Second Amendment. In point of fact local police cannot be compelled to enforce federal law.

    This whole story originated on some survivalist/militia/anti-government web site. Then similar sites copied it.

    Give it a rest.

    Thanks Carl, I needed the information you provided so I respond to people who confront me with, "hey, did you hear....". This rumor going viral on the internet and I am starting to think that it is a plant to strain relations between USSS and local Sheriffs, especially in Colorado.

    You know, I had been a deputy sheriff for four years before I was appointed to the Service.

    One of the first things that I realized as a new Secret Service agent was that I no longer had any more authority than an ordinary citizen to make arrests for violations of state law, like DUI and armed robbery. Back in those days there were virtually no states that granted Peace Officer status to federal agents.

    Over the years it has gradually changed and most states now give some kind of authority to many federal agencies to arrest for violations committed in their presence without having to go through the "citizens arrest" procedure.

    And, of course there are three agencies that have the authority to arrest for any federal offense: the Secret Service, the U.S. Marshals and the FBI.

    I was a Patrol Officer and Intelligence Detective in St. Louis/St. Louis County for 7 years and in the early days of my checkered career in the Service, I was counseled more than once about "hanging out" with the local PD's and SO's lest I be tempted into doing "Police work". There is no such thing as "Citizens Arrest" in North Carolina. Federal Agents do not have Peace Officer status here and I doubt they ever will. The "War of Northern Aggression" is still being fought in the areas outside the Liberal population centers which, as of yet, do not carry the vote like the cities of Denver and Boulder, CO. The actions of the FBI and U.S. Marshals during the civil rights era would be a sticking point in attempting to give them Police powers on equal footing with the Sheriffs Offices. ATF agents are also now seen as "Agents of Oppression", as IRS has always been. The Sheriffs' Association wields a big stick in the Legislature. I live in what can be described as a rural area. People around here who have not buried the firearms and ammunition seriously talk about "filling sandbags, stock piling MRE's, and loading magazines". The election of 2016 will be the tipping point in determining whether this country remains a Constitutional Republic, unless actions in the Oval Office precipitate a Constitutional crisis sooner. I never thought I would see the day. Stay safe.
