    Supreme Court declines to review case of former candidate

    TAMPA — The Florida Supreme Court will not hear a case involving former Tampa police Capt. Marion Lewis, who was forced to resign his job to run for mayor, affirming an earlier court win for him.

    The court Tuesday declined a request from the city of Tampa for a review of the case. The refusal lets stand an earlier appeals court victory for Lewis, which found that his qualifying as a candidate for mayor was not effectively a resignation.

    Attorneys for the city had claimed that state law does not allow police officials to run against their bosses, who have authority over their jobs.

    Lewis, who was terminated from his job after qualifying as a candidate in the 2007 mayor's race, later lost to Pam Iorio.
