    Cape Coral police face lawsuits over arrests

    The Cape Coral Police Department received notices Wednesday morning from two men who claim they were unlawfully arrested and intend to sue.
    Both claims were prepared through the Miami-based law firm of Baron & Herksowitz.

    One claim alleges Shawn Cleaver, 37, was injured in an unlawful arrest Juy 4, 2009. Cleaver was arrested on charges of battery on law enforcement, which was dismissed, and resisting an officer without violence, which was not filed, according to the claim.

    The claim states Cleaver attempted to walk through a private parking lot with his child and a security guard would not permit him to exit. Cape police officers arrived and with the guard they allegedly “threw him to the ground, Tasered him twice and pepper sprayed his face,” according to the claim.
    Cleaver’s 7-year-old child was allegedly pushed into a tree and suffered bruises, the claim states.
    Another claim from Ronald Abt, 41, alleges an unlawful arrest July 5, 2008. Abt was accused of being drunk or on drugs during a traffic stop, according to the claim.

    Abt was arrested in his driveway after field sobriety tests on a DUI charge, which was dismissed, according to the claim.

    Where does this guy live? Is he in the Cape or is he from the east coast like the attorney who hired him? What does he drive? What does he look like? Is he just showing up on scenes?
