Leaving a wallet, money and credit cards overnight in a patrol car is poor judgement on Tom Knight's part (rookie 101). Any cop would be embarrassed if the newspaper found out about it. Conversely, Marcy's Law is not designed to shield Knight's name from public view in this instance. With Kurt Hoffman's help, let's do a legal analysis:
- While driving his patrol vehicle on-duty, Knight left his wallet, money and credit cards in his vehicle overnight. Then his valuables were stolen by a thief.
- Knight's name is redacted from the official crime report to hide his identity from the public.
- Judge Charles Dodson ruled that officers names cannot be hidden from the public under Marcy's Law, when the officer is a victim due to his on-duty actions.
- Knight is a victim of his own on-duty negligence (rookie 101).
As the elected sheriff of Sarasota County, people want to know if Knight's on-duty behaviors are negligent.
