Sgt.’s and Lt’s doesn’t wear BWC for whatever reason. And they should cause they make contact with the public just like officers does.

Fact, under Florida Statute, Section 901.151, a police officer has the authority to effect the following:

(2) Whenever any law enforcement officer of this state encounters any person under circumstances which reasonably indicate that such person has committed, is committing, or is about to commit a violation of the criminal laws of this state or the criminal ordinances of any municipality or county, the officer may temporarily **detain** *such person **for the purpose of ascertaining the identity of the person temporarily detained** and the circumstances surrounding the person’s presence abroad which led the officer to believe that the person had committed, was committing, or was about to commit a criminal offense.

Officer would do well to commit FSS 901.151 The Florida Stop and Frisk Law to memory or keep it as a favorite in the officers' laptop or smartphone.

Regrettably, citizens, even the smart ones, like this doctor, are ignorant to the fact that under FSS 901.151, police officers have considerable authority to detain and demand identification, when alerted by observed behavior that based on experience and training, raises an alarm that a crime is being committed, was committed, or is about to be committed (Terry v. Ohio, 392 U.S. 1 (1968). *Below is the Hiibel example: *

In Hiibel v. Sixth Judicial Dist. Court - 542 U.S. 177, 124 S. Ct. 2451 (2004), the Supreme Court upheld Nevada’s “stop and identify” statute, reasoning that requiring individuals to identify themselves to police officers investigating crimes was not unreasonable. The law did not violate the Fourth Amendment prohibition on unreasonable searches, nor the Fifth Amendment right against self-incrimination. *

Unless there are other factors, of which we are not aware, the Sergeant's actions, pursuant to the above-cited examples, seem legal. REmember Knowledge Is Power!

I think commanders and chiefs should wear them as well they have more contact with the public. They can put it on when they get in and dock them when they leave.

Time for Miami Police Chief Jorge Colina to issue an urgent Departmental Order; one he should have generated long ago:

Effective immediately, when sworn personnel observe a Black citizen engage in behavior that based on the sworn members' experience and training, raises the alarm that a crime was committed, is being committed, or is about to be committed, police personnel will not engage. Instead, Miami police personnel will make a U-Turn and proceed in the opposite direction. Failure to comply will result in progressive discipline.
