Hey mod, where did the thread go concerning the most recent Federal judge's decision against Sheriff Tom Knight? It's the case where another deputy (Frank Bybee) is suing Knight in Federal court.

People don't believe me when I tell them that Knight tried to get the case thrown out because Bybee used the word "received" instead of "filed," but if the link to the case is re-posted, then people can read it for themselves. It's getting crazy on the 2nd floor with that information being released for public review.

The defendants correctly note that Bybee failed to use the word "filed," but instead, Bybee alleges that Knight "received" a complaint from one or more of the defendants. The Court will not dismiss Bybee's action simply because he failed to use magic words, when the pleading is otherwise sufficient.

Bybee's complaint alleges that the defendants submitted a baseless and punitive complaint to Knight, in retaliation for Bybee's exposing [bad] business practices on TV. Dismissing Bybee's complaint for the failure to choose the correct words, when the meaning of the allegations is clear, would return us to the days of the common law forms of pleading.

This case could get ugly, due to damage control issues.

The judge said that Knights defense team wanted to throw out Bybees case with "magic words" or some such nonsense. If it were not printed in the court record, nobody would believe is. Disney has the magic kingdom and we have the 2nd floor. Both live in a world of fantasy.

Drop the crack pipe before you accuse others smoking dope. If you had done your due diligence and looked at the ENTIRE case which is here http://law.justia.com/cases/federal/district-courts/florida/flmdce/8:2015cv01026/309992/23/ you would have found those words from the court on page 2 under Count III.

The Conley defendants motion (Doc. 5) to dismiss is GRANTED IN PART. Count VI is DISMISSED WITH PREJUDICE.

Mr. Knight wants !@#$%^&* magic words to be used?

The court describes Knight's demand for Bybee to use "magic words" as being unrealistic. In the real world, that crap won't fly -- it only flies in the unrealistic world of the 2nd floor, but that crap won't fly in Federal court!

Disney has the magic kingdom and the 2nd floor has magic words, but both are a fantasies. The Federal judge is forcing the Knight-Hoffman dancing duo to step back into legal reality, even if only for a moment.
