This Police Department has become a joke. Look at the video and see what a bunch of fools is the city of miami police department staff. Herbello the best thing you did was stay quiet. Can u guys imagine a major incident and these fools giving statements.

This is what happens as a result of Affirmative action, coupled with the Banana Republic mentality :oops: I wonder how much they had to pay these clowns $$$$ (what 5 or 6 majors ? ) to attend this circus ? Whats even funnier is everyone of them is about 5' 4" tall , little Napoleon mentality at it's finest :snicker:

Glad I am retired . These men whom I worked with are no longer Law Enforcement they are between pathetic and a joke. Proud to see the officers stand up to these clowns. Good luck to you guys. :evil:

If a police chief is directed by the city manager, as clearly was the case here, to order off-duty police officers under his command not be armed when voicing their grievance at a Commission hearing, at least provide executing command officers with the statutory authority “chapter and verse” authorizing such exclusion. Below is an excerpt from Florida Statute, Chapter 790, Section 790.052 – Carrying concealed firearms; off-duty law enforcement officers. Orosa should’ve vetted this point of law with the city attorney before launching his command staff into the maelstrom, they looked foolish:

“. . . Nothing herein limits the authority of the appointing or employing agency or department from establishing policies limiting law enforcement officers . . . from carrying concealed firearms during off-duty hours in their capacity as appointees or employees of the agency or department.”

Well according to the cited FSS 790.02 excerpt, NBO can limit Miami POs . . . from carrying concealed firearms within the commission chamber when off-duty and in particular when ardently voicing pay and benefits grievances. Additionally and which I did not previously post, HR 218/Law Enforcement Officers Safety Act provides the following restrictive authority to state and local governments:

(b) This section shall not be construed to supersede or limit the laws of any State that (2) prohibit or restrict the possession of firearms on any State or local government property, installation, building, base, or park.

Yeah, it’s unpalatable, but on this one, NBO has the law on his side. He just did not or could not clearly articulate it. Open and read the below link to learn more; the source is credible:

I think the question at hand isn't whether or not Orosa has the right to restrict his officers from carrying firearms in an official capacity - no one, for example, disputes his right to have officers put their guns away in prisoner processing - but rather whether or not he can restrict them from carrying firearms as private citizens. When officers voice their concerns, however ardently, about their pay and benefits they are acting as private citizens in accord with their First Amendment right to free speech, not as, "appointees or employees of the... department." Pleading with a local government commission for better wages cannot sensibly be construed as a police action. As for HR 218, you will note that a police chief is not a legislator and is not empowered to make new laws - he can only enforce current laws. You will also observe that HR 218 specifically reserves the power to regulate possession of firearms on local government property for the State government. Accordingly, directives from a police chief - or resolutions by the City Commission, for that matter - lack the necessary authority to strip private citizens of their right to bear arms on any government property.
