Pichardo never INTENDED to steal that horse and INTENT is at the crux of any criminal prosecution. The fact is he was caring for and training the horse until such time as the City of Sweetwater ask for the steed. Let's face it, keeping and caring for a horse is an expensive thing, so in the final analysis, the city of Sweetwater may owe Pichardo money for boarding the horse after all.
