Ex-Miami Beach cop charged with illegal gun sales

After at least three years of illegally selling firearms at gun shows throughout Florida — mainly in West Palm Beach — and telling undercover federal agents that selling guns without any papers is the way to do it, a 55-year-old former Miami Beach police officer is facing federal charges in Palm Beach County.

Bureau of Alcohol Tobacco and Firearms agents started their investigation into Jose A. Quintana in March 2009.

Facing a charge of dealing firearms without a license, Quintana attended his first appearance Monday morning. A judge ordered he be held on $200,000 bail, court records show.

After investigating Quintana’s bank accounts, an ATF agent found that from 2008 to 2011 Quintana deposited about $107,946, which was cash made solely from selling the firearms at shows across Florida, including in West Palm Beach, Fort Myers, Fort Lauderdale, Orlando and Miami.

“It appears that his principal objective is to obtain a profit under the guise of making ‘private sales,’?” the complaint says.

Income from KAPP Industries, which currently employs Quintana, and the Miami-Dade County Public School District, which employs his wife, Joanne Quintana, was not included in those deposits, according to a federal complaint.

One of the first guns that was investigated by ATF was a Glock 9 mm pistol found in Guatemala in October 2009.

ATF agents traced the gun to Quintana and a partner, identified only as R.V. in the complaint.

A Palm Beach County School Board police officer sold the Glock 9 mm pistol to R.V., whom the officer saw many times at gun shows in Palm Beach and Broward counties. The officer, who became a witness in the case, identified Quintana as R.V.’s partner, according to the complaint.

R.V. and two other people, identified as T.V. and J.R. in the complaint, also are being investigated as unlicensed dealers.

In September 2011, Quintana, R.V. and T.V. were selling about 148 guns, mostly handguns, at a show in West Palm Beach.

Two months later, Quintana sold another gun in West Palm Beach to an undercover agent. The agent told Quintana he wanted a gun for his personal protection. Quintana recommended a Glock 9-mm handgun for $600. The agent did not have to fill out any paperwork, the complaint says.

Just three months ago, Quintana sold an undercover agent a Sig Sauer handgun at a gun show in Fort Myers. He told the agent the benefits of a “private sale” rather than buying from a licensed dealer.

Quintana said by buying a gun in a private sale the buyer can “avoid possible future government regulations that might limit firearm ownership, taxation and the buyer can transfer that firearm to whoever he wants,” the complaint says.

In May, Quintana met with an undercover agent at a Shell gas station in Miami-Dade County, where the agent bought a Glock handgun. Quintana told the agent he started “acquiring guns as a hobby.”

Quintana explained that the law “allows an individual to privately sell a reasonable unspecified quantity of firearms,” according to the complaint.

He told the agent, “Let us say, 12, 24, 36, 50 firearms per year. Let us say, reasonable .?.?. I surpassed that a long time ago.”

He also admitted to “constantly” spinning funds he makes from gun sales to enable him to continue doing business, including paying his bills, the complaint says.

What this all comes down to is everyone has a little caca. Some more than others! The longer you leave him home the longer he has to dig and find. This is what happens when you intentionally do bad to others. Pay back is a b and since you are the top dog you are ultimately at fault. I know you will bat those big brown eyes and play dumb. Thats not working so well anymore.
The only person that has ever known the real JP ran for the hills when he saw the writing on the wall. Just enjoy your raise and pension and leave everyone alone. Tell your dream team to do the same.

MIAMI -- A South Florida police officer and his wife are facing charges of illegally selling hundreds of weapons over the Internet and at gun shows.

Prosecutors said Friday that 42-year-old Hialeah police officer Rafael Oscar Valdes and 45-year-old Tammy Lynn Valdes were charged with dealing firearms without a federal license. That carries a maximum five-year prison sentence. Rafael Valdes also is charged with making a false statement regarding a firearm. That carries a maximum 10-year sentence.

Authorities say the couple sold at least 100 firearms over the Internet to people in 44 states since 2005. They also allegedly sold more than 500 weapons at gun shows. The indictment says nine weapons were sold to undercover agents.

Sources say that there may also be more arrests pending.

Court records did not list attorneys for the couple. Their arraignment is set Jan. 11.

A Hialeah police officer and his wife — herself a former cop — were indicted this week on charges of illegally selling at least 600 guns over the course of seven years.

Rafael Valdes, a current Hialeah officer, and Tammy Valdes — who was a cop for West Miami and Golden Beach — were caught dealing firearms without a license, according to the indictment, handed down by a federal grand jury in West Palm Beach.

Rafael Valdes is also accused of lying when he tried to buy a gun, saying it was for him when the firearm was really meant for someone else, according to the indictment.

The couple are accused of buying and selling guns without a license since at least 2005. They sold more than 100 weapons online and sold 500 more at gun shows throughout South Florida, according to the indictment.

“The defendants sold nine firearms to undercover agents, solicited the purchase of firearms from undercover agents, and offered to acquire firearms for undercover agents,” according to the indictment.

Investigators seized five rifles, four shotguns and 38 handguns from the couple. Eleven law enforcement agencies helped with the gun trafficking investigation, including the U.S. Justice Department; the Bureau of Alcohol, Tobacco, Firearms and Explosives; the Broward Sheriff’s Office; and the Hialeah Police Department.

Hialeah police released a statement saying that Rafael Valdes’ arrest is “not related to any of Officer Valdes’ official Hialeah Police duties or capacity. The investigation involves off-duty activities.”

“Subsequent to today’s arrest, Officer Valdes has been suspended pending further action,” wrote department spokesman Carl Zogby.

Attorney Michael Feiler is representing the husband and wife.

“It’s really too early for me to comment,” Feiler said Friday. “I’m confident that, at the end of the day when the truth comes out, my clients will be vindicated.”

Feiler has represented Tammy Valdes before, when she recently sued Golden Beach. Valdes claimed she was fired after complaining about harassment from a supervisor, as well as officers “double dipping” by working off-duty security jobs while on duty.

In September of this year, an eight-person jury awarded her $158,000 in back pay, plus $75,000 for pain and suffering. She was also offered her job back, but she went into retirement, Feiler said.

The two surrendered voluntarily to law enforcement on Friday and were released on bond, Feiler said.

Each faces five years in prison and a $250,000 fine. Rafael Valdes faces an additional 10 years and another $250,000 for lying about the sale of a weapon, according to the charges.

A former Miami Beach police officer pleaded guilty Friday to selling firearms without a license in one of the largest firearms seizures from one person in the Southern District of Florida, federal prosecutors said.

Jose Antonio Quintana, 55, of Virginia Gardens, faces up to five years in prison at sentencing, scheduled for Jan. 18. He's also agreed to pay $10,000 to the ATF for investigative costs and will forfeit a large cache of seized weapons that includes 96 rifles, 79 shotguns, 418 handguns and approximately 25,889 rounds of ammunition, prosecutors said.

According to the U.S. Attorney for the Southern District of Florida, Quintana attended numerous gun shows across Florida between Nov. 2008 and July 2012, where he sold firearms as purported "private sales."

That allowed Quintana to operate as a cash business without a storefront, without reporting his activity to the ATF or completing ATF paperwork and without conducting background checks on customers, prosecutors said.

Although Young was shivering in his boxers and wishing he were never involved in this mess on the day of the Lt's hearing when his attorney made him look like an idiot... but unfortunetly at the end of the day the LT was unlawfully fired thanks to all those devils :devil: :evil: :devil: :twisted:

But the sun will shine again and the LT will be in a much better place i'm sure. anything is better when you have a pocket full of cash and your working in a real police dept.
All of this happened for the benefit of the LT so he can get out of this hell hole.
He might be angry and feel betrayed now, but one day he might even thank that old disgusting witch for doing this.

The LT's hearing was like a hearing out of a movie based on communism or any 3rd world country. Glad to hear that the other 2 officers will have a fair chance. FINALLY! Something will go fairly for these guys. And when they get cleared it will just make the LT's lawsuit EVEN MORE powerful... We are going on almost 2 yrs of this nonsense using the taxpayers of medley's money. LOVE IT! The town has spent so much money saving face for this idiot chief that they could have put all this money together and done tremendo plastic surgery on her from head to toe and she would look like Kim Kardashian. Maybe that way she could keep her husband from cheating on her... NAH maybe not, no plastic surgery fixes a low IQ or a rotten heart :devil:

Only Medley PD will promote to Captain a guy who violates the police officers bill of rights and admits to destroying public records under oath. A small price to pay to help set up innocent officers. Congrats Jack no one will ever respect you not that you care anyway.
