Golden Beach Interim Police Chief Rudy Herbello Accused Of Obstruction

The Town of Golden Beach Police Department is in turmoil. In April, two officers were criminally charged with defrauding the small enclave by double dipping. Yovany Diaz, 33, and Omar Paez, 41, are accused of working off-duty overtime details while on their regular duty assignments; altering reimbursement invoices; and failing to pay the town for administrative costs connected to their overtime.

Now Interim Police Chief Rudy Herbello wants to put the kibosh on the ongoing criminal investigation, according to current and former Golden Beach police officers. We are not revealing their identities to protect the one who is still employed by the town.

Last week, during an orientation at roll call, Herbello allegedly informed his subordinates in attendance that he "was going to have a meeting with the Miami-Dade State Attorney's Office to drop the criminal charges against the accused officers and let him to do an in-house administrative investigation," says the cop who was present. Herbello also "threatened to fire anyone who talked to people outside the department about what he said," the cop added.

The former Golden Beach police officer heard the same story from other rank-and-file members of the police force. "It doesn't look good for the interim chief," the source says. "They replaced Frik with Frak." Herbello took over from Jim Skinner, who resigned shortly after the arrests of Diaz and Paez. The pair remain on duty in administrative positions and are being allowed to drive unmarked cars. Heck, Herbello even promoted Paez to acting lieutenant.

A call to Herbello -- who unsuccessfully ran against county Commissioner Joe Martinez in 2008 -- was routed to a Golden Beach spokesman, who provided us with a prepared statement from town Mayor Glenn Singer that somewhat denies the allegations against the chief:
Two days after Herbello was named, he held an orientation meeting (one for day shift and one for night shift) with his staff to talk about his goals and expectations for the department...During the orientation meetings, the Chief mentioned that since he was new to the job, he was going to try to reach the State Attorney's office to introduce himself, get up to speed on their investigation and see if there was anything more the Town could do to provide additional assistance. Also at the meeting, Chief Herbello reminded the group, that as sworn officers, they had an obligation to uphold the Town Charter and take no actions that would be considered adverse to the department's will, and if they did, would face possible disciplinary action.

Singer adds that Golden Beach's police union contract requires the town to provide cars to Diaz and Baez, even though both officers are on desk duty. "Since the two are not engaged in active law enforcement work, they have been assigned unmarked cars in lieu of marked police cars," Singer says.

Prosecutors have not met or spoken with Herbello, says Miami-Dade State Attorney spokeswoman Terry Chavez. "We are proceeding with our prosecution of the officers who have been charged and the investigation continues," Chavez affirms. "We have facts and evidence against these officers."

Since 2009, the Florida Department of Law Enforcement, the Miami-Dade Police Public Corruption unit, and the state attorney have been investigating criminal allegations into the Golden Beach Police Department. Diaz is accused of stealing $2,032 and Paez of taking $1,450.

Six months before Diaz and Paez were busted, Sgt. Lynn Dean Peters, 45, was charged with one count of organized scheme to defraud, one count of grand theft, one count of insurance fraud, and 11 counts of official misconduct. Unlike Diaz and Paez, Peters is suspended with pay pending his trial.

In an unrelated case last year, Lt. Roberto Barrio was found guilty by a Gainesville jury of kidnapping and battery of his wife. Barrio was allowed to continue working for Golden Beach right up until his verdict. Before Barrio was convicted, town Mayor Glenn Singer told New Times that Golden Beach "affords all its employees the right to due process."

Man you people love making shit up don't you. 1. There have been no charges of altering reimbursement invoices. 2. The interim chief never threatened to fire anyone for talking about what he said. He said he would fire you if you talked about town business with anyone outside.....because it is against policy and grounds for dismissal morons. And of course he wants to put the "kibosh" on the investigation. As you said yourself, its been going on since 2009 and has had the department in turmoil.....and over several "thousand" dollars, not millions. And dont start with your "it doesnt matter how much", "these unethical officers" blah blah blah. Thats not the point. The point is its absurd the investigation has gone on so long extending the ongoing turmoil unnecesarily. Do your investigation, make your arrests, and get it over with so the department can start to recover. If its taking you this long, to find a few grand.....then your investigation is obviously weak and desperate and you have to grasp at every straw. For the love of God stop digging just to try and justify all the time spent on this and get it over with already.

Greetings and Happy Memorial Day Weekend to all of our veterans who have served this country, some making the ultimate sacrifice. On this weekend we honor you! Now on to business, it is nice to see that finally someone with some education and a little mastery of the english language is posting on behalf of the parasites that plague this department. Please do elaborate on the shizzat that is being made up or posted on here. Are you absolutely certain that there has been no changes or altering reimbursement invoices? Sounds to me that would meet the elements of an official misconduct charge. The interim Chief would like nothing more than to put the "kibosh" on the investigation because that would guarantee him the job of Chief of Police for this corrupt little department. However, unless he chooses to turn states witness and cooperate with the State Attorneys Office (which I might add, he has prior experience with from his involvement in the Miami voter fraud case) it would be in his best interest to keep his nose out of the investigation. {edited to comply with terms of use} It is rather humerous that the Moderator of this site thinks that he can selectively delete posts that have been placed on this blog about Rudy or other corrupt members of this department in an effort to continue to silence the corruption in this town that stems from the highest elected office in this town and trickles on down.
The investigation has been a long one and shall continue until each and every corrupt officer and politician in that agency is brought to justice. The State Attorneys Office, FDLE, and the Miami Dade Police Department Public Corruption Bureau do not dance to the beat of your drum. This investigation WILL NOT end until they say it is over and not because the heat is too high and alot of the dirty cops can't seem to take it any longer. I am so sorry about your "turmoil" but frankly the only "turmoil" going on is within those who are being looked at and possibly facing criminal charges. "And over several "thousand" dollars, not millions". Do I need to even need to even begin to comment about or question your integrity after making such a statement? Police officers and elected officials take an oath to serve their community and as such are held to a higher standard. Although most of the elected officials and police officers in the town of Golden Beach do not uphold this standard and think they are above the law because of the empowerment they have from their positions withing this 1.3 mile strip of land, we the public and taxpayers hold each and everyone of you accountable for your actions or the lack there of.
The investigation continues and more arrests are forthcoming. For now I leave you with this, if in fact this investigation was so ridiculous and the case was all full of holes, olease answer this one last question for me. Why did {name edited out} surrender himself to the State Attorneys Office and cut a deal for immunity? Who do you think he betrayed to keep himself out of jail? Let's just say you should never trust a person with a drug problem. For now I leave you with one last thing, Jim Skinner you know the difference between right and wrong. That is why you are no longer the Chief. You stand the most to lose, not to mention the polotical black eye to your spouse.

This guy was a joke at MPD, His wife was imvolved in voter fraud in 2003, and he said he do not know! LOL. He left MPD after they found that he was abusing overtime Sgt Herbello was having the cases cleared by ECA instead of investigating them. The State attorney office did look into however he bailed MPD. Mr. Mayor if you want to fix the problems in your City, hire from the outside and find someone with a clean background and IA experience.
