Four indicted in $1B viatical fraud case

Five years after their company was shut down, four officials of a viatical and life settlement company have been indicted.

In a 25-count indictment, Joel Steinger, Steven Steiner, Michael McNerney and Anthony Livoti Jr. of Mutual Benefits Corp. were charged with, among other things, conspiracy, mail fraud, wire fraud and money laundering.

The company raised more than $1.25 billion from more than 30,000 investors before being shut down by federal regulators in May 2004. More than 28,000 victims lost about $837 million.

The defendants made millions of dollars and, in some cases, lived extravagant lifestyles that included million-dollar homes, expensive cars, horse farms and international travel, according to a press release issued on Monday by the U.S. attorney for the Southern District of Florida.

McNerney and Livoti, both attorneys made their initial appearances in federal court Monday where they pleaded not guilty. Steinger and Steiner are expected to appear in court later this week.

Mutual Benefits sold viatical and life settlement investments through an international network of sales agents, according to the press release.

The indictment alleges that the company’s sales agents and marketing materials falsely promised investors “safe” investments in “secure” life insurance policies.

A viatical, or life settlement, is an investment in which an investor purchases the right to receive the benefit on a terminally ill or elderly person’s life insurance policy.

An investor in a viatical or life settlement profits when the insured dies and the benefit paid is more than the price paid for the policy and the expenses that were needed to keep the policy active.

The company is alleged to have engaged in wide-scale fraud by improperly acquiring policies that could not be bought and sold, pressuring doctors to rubber-stamp false life expectancy figures and mismanaging premium funds in an unsustainable Ponzi scheme, according the press release.

A Florida lawyer has pleaded guilty to conspiracy in the fraudulent sale of life insurance policies held in the names of AIDS patients.

Michael McNerney of Fort Lauderdale admitted he provided “legal cover” to help top executives with Mutual Benefits Corp. lure investors to buy the policies purchased from AIDS patients, the Miami Herald reports. McNerney said he plotted with the executives to mislead investors about the life expectancy of the AIDS patients and the risks of the investment, according to a factual statement filed with the federal court in Miami.

Colleagues were said to be stunned in 2009 when they learned of the charges against McNerney in connection with the alleged scheme. The case against another Fort Lauderdale lawyer charged in the case, Anthony Livoti, is still pending.

The Miami Herald says the alleged scam is one of Florida’s largest fraud prosecutions, ranking behind the $1.2 billion Ponzi scheme by former lawyer Scott Rothstein.

I have known Anthony Livoti for over 20 years, he is one of the most honest people I know. I don't care who he is representing. That is his job as FOP attorney. Focus your hate in the right direction.

A copy of this link is being forwarded to some of the victims in Mr. Livoti's case for their review and so they may feel free to post their comments on this site. Mr. Livoti is truly a befitting choice of counsel to represent all of these "innocent officers who have been framed". Counsel should have that line down to a tee.

What are the chances McNerney will get a less sentence time than his colleague Scott Rothstein.
