On Sunday morning August 2, 2010 at approximately 1:30 a.m., Madison County Sheriff’s K-9 Corporal Mike Maurice attempted to stop a vehicle for going 103 MPH in a 70 MPH zone on I-10. As he pulled behind the vehicle It took a hard right turn into the DOT weight scale station and got caught between some semi’s waiting in line to be weighed. Corporal Maurice ordered the driver into the parking area to conduct the traffic stop. During the stop, Corporal Maurice saw marijuana in the vehicle in plain view. The driver was continually saying that the marijuana was his and not the passengers. Finally Corporal Maurice advised the driver that if he wanted to claim the marijuana that he must read him his Miranda rights first. After hearing his rights, the driver then told Corporal Maurice where all the marijuana was located in the vehicle. During a search of the vehicle, Corporal Maurice also located several marijuana-smoking pipes and some amphetamine prescription pills. The pills were in an unlabeled plastic bag, The driver also claimed those. The driver Joseph Horwitz, of Birmingham Alabama, was arrested and taken to the Madison County Jail. The passenger was released with no charges.
