could it be possible that the surviving victim does not wish to go through a trial for fear of her safety? the subject had her id and address etc.,,

if she is terrified by the whole ordeal,, she may have changed her mind since august 2007, and maybe no longer wants to identify the subject any longer..

maybe she does not want to go through a trial and get all the publicity for fear of her own safety...??
