Two Charlotte County deputies suspended
Deputies Paul Davis and Michael Kyle Martin results in one sustained allegation for Davis, two for Martin
An internal investigation of two Charlotte County Sheriff's deputies resulted in both being placed on unpaid suspension and a probationary period. Deputy Paul Davis and Deputy Michael Kyle Martin were investigated by the Sheriff's Office after arresting an 18-year-old woman at a party at Martin's Deep Creek home for allegedly stealing a bottle of liquor. The arrest was later thrown out.
According to an internal affairs report, the men were at the party with the woman, who told other guests she was 24 and consumed the alcohol that was available. Before leaving the party, she asked Martin if she could buy a bottle of alcohol from him, which led to questions about her actual age. When a man arrived to pick the woman up, Martin noticed some alcohol was missing from his home. Martin saw a bottle of Bacardi Razz in the car with her.
Martin and Davis arrested the woman on a charge of petty theft, but that arrest was voided because neither officer had seen the alleged theft. Both men had been drinking at the time. Both were investigated for allegations of conduct unbecoming an officer and neighborhood or family disputes, which prevents members of the CCSO from making arrests in matters involving their own family or neighborhood quarrels. Martin was found to have violated both rules, while Davis was found only to have behaved in an unbecoming manner.
"There is certainly nothing wrong with holding a BBQ and inviting family and friends to attend," wrote Sheriff John Davenport in the report, adding that the consumption of alcohol was also all right. "What I do have a problem with is that our staff should realize that our actions both on and off duty reflect on this office."
Davis was suspended without pay for 40 hours and placed on a six-month probationary period. Martin was suspended without pay for 80 hours and placed on a six-month probationary period.
