2004 13th check

Anyone know anything about a 2004 13th check that is pending??

I have heard that several firefighters are suing for the 2004 13th check. It is their belief that the fund owes us a check. According to them the fund made over 17% which should have triggered a 13th check. The pension fund stated it was still a make up year for losses, so they did not pay one. The firefighters stated that nowhere in the contract for a 13th check does it state they can hold paying a 13th check for that reason. From what I understand it is in the court system now.
