If someone is married and has a kid with their spouse and they are planning on leaving that spouse, could they get in trouble for taking the kid out of the county without the other spouses permission?

Depends on who you talk to but it is Civil in nature and the ultimate decision would be left to the judge. They may get away with it at first but as soon as the case is heard in front of the judge, the judge will decide what is fair to both parties. Sometimes "Fair" is compensated by a reduction in support obligation but all that will be decided during mediation.

Civil court is a mess. You would be wise not to get caught up in their troubles and refer them to a lawyer. No one wins except for the lawyers!

Get a good lawyer, and solid custody agreement. It will end up in court anyway, so start as if you are involved in a defense of the crime of the century. In these cases a "shark" of a lawyer are worth their weight in gold.
