    Senator Steube proposes amending law to legalize guns inside Clerk of Court building

    Update on the CCW courthouse issue between:
    - Senator Greg Steube
    - Sheriff Tom Knight
    - Chief Judge Williams

      Snip: Sen. Greg Steube added language to his "proposed courthouse carry" bill to get around a crisis between himself, Sarasota Sheriff Tom Knight and the chief judge of the 12th Judicial Circuit.

      Steube triggered the impasse when he tried to enter the Clerk of Court building while armed.

      The language Steube added to his proposed amendment would define a courthouse as any building "where trials and hearings are conducted on a regular basis." His newly proposed "definition of courthouse" cannot be preempted by any judge or administrative rule and does not include judicial operations inside a Clerk of Court building.

      If a judge issues an order that conflict's with Steube's newly proposed definition of a courthouse, then the judge can be removed from office and fined.

      Steube's proposed SB 616 has one committee left — the Senate Rules Committee — before it heads to the Senate floor for a vote.

    The current law allows a judge to define if judicial operations inside a Clerk of Court building are part of the courthouse, as follows:

    • FSS 790.33 - Field of regulation of firearms and ammunition preempted.
      (4) EXCEPTIONS.— This section does not prohibit:
      (d) A court or administrative law judge from hearing and resolving any case or controversy or issuing any opinion or order on a matter within the jurisdiction of that court or judge.

    Steube's proposed amendment to SB616 would change that and would:

    • Make it legal to carry guns into the Sarasota Clerk of Court building, regardless of judicial operations.
    • Authorize the removal from office of a judge who violates the proposed new law.

    If Steube can't get the law changed or amended, then Knight will be forced to obey the chief judges orders. LOL

    Knight should have waited to see "IF" Steube can change the law, to allow CCW guns inside Clerk of Court buildings. Knight jumped the gun by withdrawing all security from the Clerk of Court facilities. As the law is written now, the chief judge's orders (to Knight) are perfectly legal. The only way Knight can save face is if Steube can somehow get the law changed in the Senate BEFORE the appeals court makes its ruling against Knight. It will be interesting to see which way the Senate votes.

    Steube is scrambling to amend the law because he knows he eff'd up ----- and Steube subsequently put Knight and Hoffman in a bind ----- because Hoffman advised Knight to disobey the chief judge of the entire 12th Judicial Circuit!!!! Knight and Hoffman unwisely chose to make a political stand for the wrong issue ---- and Knight broke the law. Oops!!!!

    A lesson in local Sarasota politics:

    1. Sheriff Knight has Senator Steube in his back political pocket.

    2. Steube is actively trying to amend the law (in SB616) to make it legal for Knight to disobey Chief Judge Williams.

    3. The governor just appointed Knight's wife to the State College of Florida Board of Trustees (it shows political connections and power).

    4. Chief Judge Williams may get a very bad taste of in-house back-woods back-stabbing legislative politics in the near future. Unfortunately. Unless Williams has judicial and political connections in the Senate?

    Either that or Knight, Hoffman and Steube are going to get a taste of their own political medicine. They are not the only nasty politicians in town!

    Sarasota County Commissioner Nancy Detert is not afraid to stand up to Knight, which may be (in part) why he is having some internal issues. Knight can push some of the politicians around some of the time, but he can't push all of the politicians around all of the time.

    Some of Senator Greg Steube's controversial gun bills are unlikely to become law. [Steube is proposing to change the law to allow guns into Clerk of Court buildings that do not house hearings or judges chambers].

    The Senate Judiciary Committee – where Steube's gun bills failed to get a hearing so far - released the agenda for its final meeting - and there are no gun bills scheduled to be heard.

    Sen. Anitere Flores, a Miami Republican, opposes Steube's proposed legislation. She appears to be the decisive vote on the Judiciary Committee - which has five Republicans and four Democrats – when it comes to gun legislation.

    If Steube's gun bills can’t clear the Judiciary Committee, they are unlikely to be heard on the Senate floor. Steube says it’s not over, but it appears to be over. Steube said in a text message that “nothing is dead” until the session ends.
