He was alerted to the federal investigation when his bank card was declined and his checking account was drained. His bank confirmed a legal order had been placed against it and provided phone numbers for attorneys working for the Department of Justice. At this juncture,, he has no legal recourse to recover his money because...

Here are the 3 main tenants of federal Civil Asset Forfeiture:

    1. The Fourth Amendment does not protect people from Civil Asset Forfeitures. Technically, the assets, cash or property are accused of a crime, but not the owner.
      .
    2. Federal agents may seize the assets, cash or property of any U.S. citizen, if agents have a hunch (mere suspicion) that the assets might have been used in the commission of a federal crime.
      .
    3. No reasonable suspicion, probable cause, evidence or charges are needed for federal agents to indefinitely keep seized assets.

A citizen may re-acquire their seized assets only if they sue and then prevail in civil court that the assets were not used in or for the commission of a federal crime. How do you prove the innocence of assets when no charges or evidence are presented by the government? These types of cases typically cost a victim between 25k and 125k or more – and most victim’s don’t have that kind of money. Example: Would you spend 25k in civil court to re-acquire a vehicle that is only worth 20k?

Civil asset forfeiture was originally designed to allow the government to skirt the Fourth Amendment, which protects drug dealers who were able to escape criminal allegations i.e. the assets are "suspected" of being used in criminal activity, even though no corroborating evidence is required to be produced. However, the civil asset forfeiture program is now being used against Jan. 6 dissenters. They program may expand nationwide, if Congress does not change the law.

    Federal civil asset forfeiture:

Long story short: Assets get gummed up in civil court and no evidence is required to seize or keep the assets.

The wrong link for federal civil asset forfeitures was provided in the above post. Here is the correct link for non-governmental civilians:
