Traffic Question
Who has the right of way, a vehicle turning right on red after stop or a vehicle in the left turn lane making a u turn on a green arrow. Both vehicles are attempting to turn in to same roadway direction.

316.1515 Limitations on turning around.—The driver of any vehicle shall not turn the vehicle so as to proceed in the opposite direction upon any street unless such movement can be made in safety and without interfering with other traffic and unless such movement is not prohibited by posted traffic control signs. A violation of this section is a noncriminal traffic infraction, punishable as a moving violation as provided in chapter 318.

316.075 - (a) Green indication.—
1. Vehicular traffic facing a circular green signal may proceed cautiously straight through or turn right or left unless a sign at such place prohibits either such turn. But vehicular traffic, including vehicles turning right or left, shall yield the right-of-way to other vehicles and to pedestrians lawfully within the intersection or an adjacent crosswalk at the time such signal is exhibited.
Notice vehicles approaching a green light may proceed cautiously through, or turn left or right. It does not give them the right of way to turn around. 316.1515 says that a u turn can only be made if it does not interfere with other traffic. A vehicle turning right on red would be other traffic.

A vehicle making a U-turn on a green light or green arrow is lawfully within the intersection. A vehicle making a right turn on red must yield all traffic that is lawfully within the intersection, Therefore the vehicle that has a red light should yield the right of way to the vehicle making a U-turn..

a. The driver of a vehicle which is stopped at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection, or, if none then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the intersection in obedience to a steady red signal may make a right turn, BUT SHALL YIELD THE RIGHT-OF-WAY to pedestrians and OTHER TRAFFIC PROCEEDING AS DIRECTED BY THE SIGNAL AT THE INTERSECTION, except that municipal and county authorities may prohibit any such right turn against a steady red signal at any intersection, which prohibition shall be effective when a sign giving notice thereof is erected in a location visible to traffic approaching the intersection.

My point is that 316.075 provides the authority for a motorist to go straight, turn right or left at an intersection. It also says that a motorist can turn right on red after yielding to all traffic proceeding as directed by the signal. (316.075 does not direct the motorist to make a u turn, only go straight, turn right or left.) Which makes the right turn on red vehicle “other traffic”. 316.1515 prohibits making a u turn if it interferes with other traffic. Further, the traffic with the green light is required to yield to other vehicles lawfully in the intersection.
Would you please provide the portion of the statutes you are referencing to support your statement?

Agreed. However, different judges might rule differently, if it's taken to court.
- If a vehicle has a green light [arrow] to enter the intersection, then they have the right-of-way.
- If a vehicle has a red light, then they do not have the right-of-way to enter the intersection.
