Also requesting text messages and call logs from charging deputies department issued phone during the time of the traffic stop to completion of arrest.

Looks like they are dropping Shelly's DUI to a reckless driving. However it does not appear they really had anything to go off of and his injury excuse was gold.

The state drops every first DUI offense to a reckless. The only time it stays a DUI on the first offense is if someone is seriously injured. The injury excuse was complete horse crap. If it was that “golden” why would he not take it to trial and get found not guilty?
