    Yeah but he's going to be a millionaire after this last arrest. Orange County arrested him for something that isn't a crime. They even admitted to it and requested the SAO drop the charges before First Appearance and had the the Clerk of Courts office remove the charging documents. Complete screw-up on OCSOs part.

    Sovereign immunity! He will get nothing and is an idiot if he thinks with his history of arrest a jury will rule in his favor. I believe he should be in prison. Look at all the crashes this fool and his company have caused. Someone needs to sue him!

    If he files in federal court under 42 USC 1983, there is no sovereign immunity and the Deputies can be held personally responsible. I agree that he should be in jail at the very least (he's out on bond on several felonies) but he isn't. At the time of the stop he was a free American citizen lawfully driving down I-4. The OCSO Deputies saw him riding, recognized him, saw the "firearm" on his "duty belt" and thought they could get one over on him. Ostensibly, the stop was righteous because they saw a known felon in possession of what they reasonably believed to be a firearm.....ok. But then, after the "firearm" was determined not to be such, but rather a lawfully-possessed item, they still arrested him, towed his motorcycle, held him at the Sector Office and then booked him into Orange County Jail on a "carrying concealed weapon" charge. Of course this doesn't make any sense because it wasn't a prohibited weapon (it was a pepperball launcher) and it certainly wasn't concealed because they originals stop was due to the Deputy seeing it openly displayed in the holster.

    After it was determined by OCSO and the SAO that the charge was bogus, they had him released, quashed the charging documents with the Clerk, and even sent a Deputy to drive him home from the Booking and Release Center.

    It was a bad arrest; the Deputies unlawfully deprived Dewitte (who again, I believe should be on jail) of his right to be free after the take-down on I-4. The Deputy might have had reasonable suspicion of Felon In Possession Of A Firearm but once that suspicion was dispelled he should have been sent on his way, not detained for hours first at the OCSO Sector Office and then at the Orange County Jail.

    As LEOs, we can't lock people up because we don't like them; we have to base our arrests on the actions and not the person.

    Keep dreaming, if a person has the reasonable belief it is a firearm! Perception is 90% of the law, you would never get a jury to rule for him with his record, I doubt you would find any bleeding hart liberal attorney to take the case without providing up front hoards of cash to cover the expense. Like I said the guy should be in prison, and any reasonable person on a jury would quickly see that he has lived the life of a dirt bag gaming the system.
