Let me educate this dummy sergeant who is looking for a lawsuit that takes away every penny in litigation, probably his retirement.
An airport terminal is a nonpublic forum. See International Society for Krishna Consciousness v. Lee, 505 U.S. 672 (1992). The Supreme Court has noted that airports are "among those publicly owned facilities that could be closed to all except those who have legitimate business there." United States v. Grace, 461 U.S. 171, 178 (1983).
Big Nick has a legitimate business there. Recording and exercising his first amendment right. Now, if you tell me that it's wrong for him to record private citizen's faces, civilians employees or private conversations, the answer is yes, Big Nick is wrong. But just recording the building, specially from the sidewalk, Rosenthal is wrong.

That Sergeant is the reverse Midas. Everything he touches becomes shitz. The airport used to be a nice place to work at, but since he got there the backstabbing increased to 300%, the petty pamphlets and stupid rules began. He only got his own back and he is an expert markman in the sense of hitting his lips spot-on in the center or commad's arse. Google job Big Nick.

The sign is there and posted for when BCAD or any other owner /operator is not there in person. When the owner/operator is there, it’s best to have them make the official request for the offending party to vacate. That being said, the LEO can not solicit the trespass from the owner/operator.
