Good question, the current Chief is bailing so as not to have to deal with this and leave it for another. If Javi was going to be fired, it would of came about a while ago. F&F are looking for a way out for him. Interesting that one could stand up in front of the entire city hall, lie and nothing but a paid vacation, comes out of it. I still say, Ortiz's has to have something good on some folks around here, cause others have been fired for a lot less. If they don't have the balls, to do what is correct and right and hold him to the same accountably as all others are held too. Then they will more then likely try to buy him out. What that is, is they will offer him $$, not to come back. It's been done before, with that officer that shot the ones on the motorbike years ago, in Overtown. When he beat the states case, against him and won his job back. The city offered him (I heard)??? 250k to go away. Yet, we all know how rumors go around here.

Yes, "The End Is Near!" An end to the unjust, to be proven illegal administrative action taken against Ortiz by the cowardly Colina. If Ortiz was such a harmful employee, why previous police chiefs, up to and including Colina, did not take appropriate progressive disciplinary actions? Cowardliness on the part of all previous police chiefs, city managers, and current incumbents. Who, after much handwringing, finally took action by Relieving Ortiz of Duty with pay pending an ostensible investigation. An investigation by whom, Dade's State Attorney Office, FDLE, FBI? As it pertains to the Ortiz case, Manager Noriega, it is time for you to evacuate your bowels or get off the pot.
Whoever Manager Noriega appoints police chief will do nothing as it pertains to Ortiz. It will take a Federal Arbitrator's (FA) decision directing the City of Miami to reinstate Ortiz for the city manager to act. The City, as it did with the William Lozano case, will try to weasel itself out of the FA's findings and order. Otiz should not take any deal the City will offer, no matter how much the City sweetens the payout. In the end, the City will yield, and Ortiz will be reinstated. As with Lozano, expect the City to pay Ortiz's legal fees and all off-duty pay he was denied earning.
The privilege of command requires that incumbents have the will, the courage to take corrective action when employees err. Most times, all that is required is a Verbal Warning, which the Sergeant retains a "Memo To File copy, for future reference if needed. Should the negative behavior persist, a Written Verbal Warning (WVW) is awarded, that is not discipline but will be retained in the awarded officer's file for two years. If, after that time period, the officer does not transgress, the WVW will be discarded. Should the officer further violate orders, then WVW becomes the foundation for the Progressive Discipline Model (PDM), up to and including termination. Open the below link and learn.
If Ortiz's past behavior was so egregious, his chain of command should have employed the PDM. Cravenly, they did not. Now it is just a matter of when he returns. Is the portly chief Morales up the challenge? By the way, Moralez reminds us of the lovable, hamburger eating Mr. Wimpy from the Popeye Cartoons.
