    You are right... but remember the Sovereign Immunity cap will max out the amount the County will have to pay. Morgan and Morgan goes after absolutely everyone they can to overcome that. Be mindful that PCSO public records will show how fast you drive for YEARS and are only a subpoena away. It is only a matter of time before deputies get sued personally with hard-to-explain reams of data demonstrating complete disregard for law or policy. As said, it is a property crime.

    The minute qualified immunity disappears that will be the day that most LEO resign, retire or quit. No sense of having some liberal judge and or jury to find you guilty of nothing more than making a legal arrest and the SAO no file the case.     "Qualified Immunity" never applies, and never has, when one acts "beyond the scope of (their) duties" - ie. when in violation of established policy. Stay within policy and you are protected (for now).

    The member's actions were reasonable and in compliance with policy, and the sole responsibility for this tragic event lies with the intoxicated pedestrian. The SA will confirm this. Plus Bob does not want to shell out the big money in case of a lawsuit.

    He shelled out 15 million before and the guy didn’t die. That was to prevent a lawsuit.
