    Everyone knows Justin Garcia went to internal affairs and got David Valentin and Danny Fernandez fired. Everyone knows he was the principle officer in baby d termination. Everyone knows Justin was written up for untruthfulness and suspended hours on arrest affidavit which it states he did it because he was having financial issues and pled the 5 th amendment by asking to certify the questions in a deposition given by Attorney Sam Rabin ( Ask internal affairs for David Valentins arbitration and its in their). Also, Justin is a documented liar ask Valdivias wife. This fat sloppy loser Justin is giving a CIP letter to Tommy Reyes on telegram and blurred out his own name. Guys call baby d , Danny Fernandez and Valentin they ll tell you what the documented liar Justin Garcia is capable of doing because he’s a malicious person. The fat Hater aka Justin also attacked Ortiz.

    Let’s read the arrest affidavit and see how just had nothing to do with them getting arrested. See below:


    AFFIDAVIT IN SUPPORT OF ARREST WARRANT
    While assigned to the Anti Corruption Unit, your Affiant led a criminal investigation involving an illegal eviction and resulting falsification of an arrest affidavit that occurred on August 8, 2009 of David Van Buren Peery, the lawful tenant of 225 N.W. 16 Street Apartment #1, Miami, Florida 33136.1 The investigation revealed that Miami police officers, Daniel Fernandez (hereinafter referred as “the subject”) and David Valentin, are partners in a property management business entitled, Land Trading Property Management. One of the properties that the subject and Officer David Valentin manage is located at 225 N.W. 16 Street, Miami, Florida . Hernan Jesus Guevara, date of birth: April 4, 1978 is an employee of the subject and Officer David Valentin and he assists in the collection of rents as well as maintenance for the properties.
    The investigation also revealed that Mr. Peery was behind in the payment of his rent, yet he was still a lawful tenant residing at 225 N.W. 16 Street #1. In fact, the subject, on behalf of Land Trading Property Management Company unsuccessfully filed a complaint for Tenant Eviction against Mr. Peery on May 18, 2009. The complaint was dismissed by Judge Bronwyn Miller on June 8, 2009.

    On Saturday, August 8, 2009, according to Mr. Peery, he left his apartment at approximately 10:30 a.m. in order to have breakfast. When Mr. Peery returned approximately an hour later, he discovered that the locks were changed.
    Shortly thereafter Officer David Valentin arrived and told Mr. Peery that he had entered the apartment earlier to conduct a rental inspection and that he found a crack pipe and other drug paraphernalia inside his apartment. According to Mr. Peery, the subject called Hernan Guevara on his cell phone.2 Shortly thereafter, Hernan Guevara arrived with the key and opened the apartment. With Hernan Guevara present, Officer David Valentin allowed Mr. Peery to retrieve some of his personal items and ordered him to leave the premises or face going to jail because, according to Mr. Peery, Officer David Valentin stated that he is a City of Miami police officer. Mr. Peery left the premises and walked to the Miami Police Department located at 400 NW 2nd Avenue in order to verify if in fact Valentin was a police officer and also to gain access to his locked apartment. Officer Luis Franco provided a sworn statement and confirmed that he was manning the front desk on August 8, 2009. Officer Franco also confirmed that a person who matched the description of David Peery approached the front desk at the police station to complain that he had a landlord/tenant dispute with someone who may have been a police officer with the City of Miami. Officer Franco advised Peery to respond back to his apartment and call 911 in order for a police officer to be dispatched to the apartment to allow Mr. Peery access into his apartment.
    A review of the City of Miami dispatch and 911 communications tapes reveal that Mr. Peery called 911 and advised that he was locked out of his apartment and needed assistance. The call was dispatched at 1:43PM for units to respond to Mr. Peery’s residence.
    Mr. Peery returned to his apartment and met with two uniformed City of Miami officers Justin Garcia and Michelle De La Vega who were already on the scene. According to Mr. Peery, Mr. Luis Gonzalez of 225 N.W. 16 Street #5 also works as the building manager for the apartment complex. Peery spoke to Mr. Gonzalez in order to get the keys to gain access into his apartment. Mr. Gonzalez then made a telephone call to Hernan Guevara. Shortly thereafter, the subject, Officer David Valentin and Hernan Guevara arrived on the scene. David Peery was then arrested by Officer Justin Garcia at the direction of both Officer David Valentin and the subject.
    Ms. Melody Johnson and Mr. Robert Fields provided sworn testimony that they were inside apartment #1 alone on the morning of August 8, 2009 when a person identified as the landlord by Mr. Peery, arrived and entered apartment #1. Ms. Johnson and Mr. Fields stated that there was a second male who was also present. Johnson and Fields stated that they were ordered to leave the apartment and they complied. Ms. Johnson and Mr. Fields further stated that David Peery was not present inside the apartment when the subject and the other male entered the apartment and told them to leave.3
    Officer Michelle De La Vega provided a sworn statement and confirmed that she responded to a dispatch to 225 NW 16th Street #1 in reference to a landlord tenant dispute at approximately 2PM involving David Peery. She confirmed that Peery told her that he had arrived at his apartment to find that the locks were changed and he could not get into his apartment. Mr. Peery identified Luis Gonzalez to Officer De La Vega as the building manager. When Officer De La Vega advised Mr. Peery that he could do whatever was necessary to gain entrance into his apartment, Luis Gonzalez, who apparently overheard Officer De La Vega, stated that the locks were changed and that he would call to get the key to the apartment. Phone records revealed that Luis Gonzalez called Hernan Guevara at 2:07PM. This is consistent with Mr. Peery’s and Officer De La Vega’s version of events.
    While awaiting the delivery of the key, Officer De La Vega learned from Officer Garcia that David Peery was going to be arrested for drugs that had allegedly been found in his possession in the apartment some time earlier. Also,

    Officer De La Vega recalled Mr. Peery advising her that the police officers had earlier stopped by his apartment and threatened to arrest him for possession of drugs. Officer De La Vega had concerns with the fact that Mr. Peery was going to be arrested for trespassing after warning when Peery appeared to be the tenant of apartment #1. In addition, Officer De La Vega also had concerns that Mr. Peery was going to be arrested for possession of drugs that were allegedly found in his possession some time earlier. She removed herself from the scene and stayed in her car. In addition, she advised Officer Garcia not to do any paperwork with regards to the arrest of David Peery.
    On September 10, 2009, a sworn/taped statement was obtained from Officer Justin Garcia who was identified as a witness in this investigation. Officer Garcia stated that on August 8, 2009, he was working in the Overtown N.E.T. Service area when he was dispatched to 225 NW 16 Street Apt. 1 reference a landlord/tenant dispute with Officer De La Vega as a backup. Upon their arrival, Officer Garcia and Officer De La Vega went to apartment #1 but there was no answer. Either Officer Garcia or De La Vega then requested the dispatcher to call the complainant back to ascertain his whereabouts.
    While Officer Garcia was waiting for an answer from the dispatcher, Mr. David Peery arrived on the scene and began to explain that the Landlord of the property changed the locks on the door to his apartment. Mr. Peery further informed Officer Garcia that the Landlord is a police officer (later identified as Officer David Valentin) for the City of Miami police department. According to Officer Garcia, Officer De La Vega made contact with Mr. Luis Gonzalez who identified himself as the building manager and advised that he would call for the key to apartment #1. Officer Garcia stated that shortly thereafter, Sgt. Ernesto Sierra raised him on the police radio and informed him that Officer Valentin was en-route to arrest Mr. Peery for Trespassing. Sometime later, Officer Valentin, along with two other white males all dressed in plainclothes (later identified as the subject and Hernan Guevara), arrived on the scene.

    Valentin told him that Mr. Peery did not live on the premises anymore and that he moved out several months ago. They informed Officer Garcia that there was drug paraphernalia found inside the apartment and they were going to arrest him for trespassing and drug paraphernalia.
    Officer Garcia stated that he placed Mr. Peery in handcuffs prior to the subject and him searching Mr. Peery. Officer Garcia stated that he did not find any narcotics on Mr. Peery’s person nor in a bag that Mr. Peery had in his possession. Officer Garcia stated that after Mr. Peery was handcuffed, he placed him inside his police vehicle. Officer Garcia stated he began filling in the top portion of the arrest affidavit using Mr. Peery’s driver’s license. However, Officer Valentin told him that Mr. Peery was homeless, so he put the address of the Camillus House located at 726 N.E. 1 Avenue. Officer Garcia stated that Officer Valentin and the subject provided him with a detailed account of what to include in the narrative portion of the arrest affidavit. The arrest affidavit reads as follows: “Det. Valentin #7358 was doing a monthly check of above property. Upon arrival, he observed two white males exit the abandoned property. The front door was open and in plain view he observed 1 glass pipe with suspected crack cocaine residue on the table and the Def inside the location. Def was asked to leave the property. He agreed in lieu of going to jail. Defendant returned to above stated property approximately 2 hrs. later. Def. Arrested. Property/Evidence turned in by Det. Valentin.” Officer Garcia later provided Officer Valentin with a copy of the arrest affidavit which he read in his presence. Officer Garcia also asked Valentin to set the pre-file conference. Officer Garcia stated that neither he nor Officer De La Vega ever entered Mr. Peery’s apartment. In addition, Officer Garcia denied ever seeing Mr. Peery inside apartment #1 that day.
    On September 1, 2009, a sworn/taped statement was obtained from Mr. Luis Gonzalez who was identified as a witness in this investigation. Mr. Gonzalez stated that on August 8, 2009, he was contacted by Mr. Peery and a City of Miami Officer who questioned him about Mr. Peery’s locks being changed. Mr. Gonzalez stated he told the police officer that Officer David Valentin and Hernan Guevara changed the locks earlier that day.
    Mr. Gonzalez confirmed that he knew Mr. Peery was residing at 225 N.W. 16 Street apartment #1 up until the day of his arrest on August 8, 2009. Mr. Gonzalez stated that a week prior to this incident, at the request of Mr. Peery, the toilet inside apartment #1 was repaired. This contradicts the subject’s statement to Officer Garcia that Mr. Peery did not live at the premises anymore and that he moved out several months ago.
    On September 10, 2009, a sworn/taped statement was obtained from Sergeant Ernesto Sierra who was identified as a witness in this investigation. According to Sgt. Sierra, on August 8, 2009, he was working an overtime traffic detail in the Overtown area when he received a telephone call from the subject. The subject advised him that he needed a unit to respond to 225 NW 16 Street in reference to an arrest for Trespassing. Sergeant Sierra stated that he raised Officer Garcia via police radio and told him to detain Mr. Peery because the subject, who was from the Crime Suppression Unit (CSU) was en route to arrest David Peery for Trespassing.
    On September 15, 2009, a sworn/taped statement was obtained from Mr. Javier Salmon who was identified as a witness in this investigation. Mr. Salmon is the owner of 225 Group, Inc. which owns the building located at 225 NW 16th Street. Mr. Salmon stated that he has a verbal contract with Land Trading Properties Management, which is owned by the subject; Mr. Salmon stated that Mr. Peery was one of his first tenants at 225 NW 16 Street. Mr. Salmon stated that although Mr. Peery was several months behind on his rental payment, he did not give the subject or Officer David Valentin permission to evict Mr. Peery on August 8, 2009. Mr. Salmon also never gave the subject or Officer David Valentin permission to have the locks changed nor remove any property inside apartment #1.
    On September 8, 2009, a sworn/taped statement was obtained from Ms. Charlene Clark who was identified as a witness in this investigation.

    Ms. Charlene Clark stated that on August 8, 2009, she observed Mr. Perry arrive home and could not get in his apartment. Ms. Clark observed Mr. Peery leave the apartment and return with several uniformed police officers. Ms. Clark observed Mr. Peery and the uniform officers standing in front of apartment #1. Ms. Clark stated that one of the officers began talking with the building manager (Mr. Luis Gonzalez).
    Ms. Clark stated that within a few minutes, several unmarked vehicles arrived, who she knew as being police officers. The plain clothes officers exited their vehicles and a white male with the long hair walked up to Mr. Peery, said something to him and patted him down, while the uniformed officer handcuffed him. Ms. Clark observed the uniform police officer place Mr. Peery inside a police vehicle. Ms. Clark later on that same day noticed several males cleaning out the apartment including a black male that lives in the area. They were removing items from the apartment and throwing them in the garbage can on the side of the building. Ms. Clark stated that the larger items were taken down the street and the more expensive items such as the television set, and tables were placed in the back of a red pickup truck. The black male, who was later identified as Michael Wilson, gave her a microwave that was removed from the apartment in exchange for some beer. David Peery never gave the subject and/or Officer David Valentin permission to remove or cause someone to remove his property from his residence. Mr. Hernan Guevara admitted that he removed Mr. Peery’s possessions from Apartment #1 at the direction of the subject.
    Your Affiant has probable cause to believe that the subject, as a law enforcement officer falsified or caused Officer Justin Garcia to falsify an arrest affidavit for David Peery on August 8, 2009. In addition, the subject deprived Mr. Peery of his property without Mr. Peery’s consent when he and Officer David Valentin ordered Hernan Guevara to remove Mr. Peery’s property from his apartment.
    Based upon the investigation conducted by the City of Miami Police, Anti Corruption Unit, your affiant has probable cause to believe that the subject, Officer Daniel Fernandez committed said crimes of one count of Theft on August

Your internal affairs profile will reflect the reprimand with 10 hour suspension. Also, when Sam Rabin asked you about the untruthfulness reprimand with suspension which is not what you posted, you refuse to answer about why you were relieved of duty? Hmmm I wonder why?
