The old irrespective test
Campaign funds can not be used to pay personal expenses that would exist irrespective of the normal expenses associated with running a campaign.
A criminal defense lawyer in this instance would probably be required regardless of the campaign because at a minimum the affidavits were falsified before he ran for office. The felonies in question that are at the heart of much of the criminal case here occurred before he campaigned and the deception involved would also be deemed to have occurred before as well.

Moskowitz, Mendel, et. Al. The funds came from the PAC that was supporting him, BROWARD FIRST. Tony would not have direct access to these funds. The disbursement would need to have been authorized by Adam Nadfler the Chairman of the PAC.
