He didn’t file a lawsuit, he filled to appeal the arbitrators decision. It was struck down at Circuit court and was then appealed to the Court of Appeals. If he would have won he then he would have been able to file suit. Both the lower court and the Court of Appeals denied his motion. The arbitrators decision held and the door for a lawsuit was shut.
