Why didn't Bell just approve Benny receiving a Sheriff's XO supplement as a SGT? IUPA had to approve it because anything involving SGT pay is a bargaining unit issue. That would have avoided this whole thing. Seems to be more Bell's fault than Benny's.

And this is why everyone is an expert at what BSO thinks they can do. According to the law, when you become the executive officer, you are no longer eligible to be in a collective bargaining unit. Therefore, even if Benny stayed as a Sgt, he was still in the official capacity of the executive officer and would have to be removed from the collective bargaining unit. I would love to see a copy of the MOU that they proposed to the Unon

Wrong. Donnie Prichard and Russ DiPerna were in the deputies/sergeants bargaining unit, and Dave Benjamin was in the LT bargaining unit. All as the sheriff's XO.

As a tactic this would work. Benny could take voluntary demotion to deputy before Israel comes in and cannot be fired. That is the move that protected Donnie Harris for years after Lamberti lost.
