    People do not understand what qualified immunity is or how it applies.

    A civil suit can be filed against any LEO at any time. The LEO then has to move to have the suit dismissed due to qualified immunity for a lawful act. Unless it can be shown that the LEO knew, or should have known, that his actions were not lawful, then qualified immunity is applied and the suit against the LEO dismissed. If it can be shown that the LEO may have known or should have known that his act was not lawful, then the suit may continue. Qualified immunity is designed to protect governments and their agents from frivolous lawsuits, which can inhibit their exercise of their duties. Knowingly violate a person's civil rights or commit a criminal act and you lose a claim of qualified immunity.

    What should be done, is to make attorneys, who bring frivolous lawsuits against LEOs, and other government agents, liable for damages to that agent along with their client. Make attorneys have some skin in the game and see how fast the frivolous lawsuits dry up. The removal of qualified immunity makes it more likely that the LEO, and his agency, will be more likely to settle a case without a trial. It only really benefits attorneys, not the public.

    If deputies violate policy they are on their own in civil suits. No Qualified Immunity.

    If deputies follow policy the agency will handle the civil suits due to Qualified Immunity.

    If the Qualified Immunity law is removed then deputies will be on their own in civil suits.

    Is that why there was a senate bill to make the PCSO and the taxpayers pay Virden's $750,000 verdict for shooting an unarmed handcuffed guy in the back of a patrol car? It is ALL a scam and it is all coming down.

    He sent an email about it this morning. Its obviously being considered. If it passes I can safely say I'm out. This job isnt viable without QI. You're a fool if you stay, and you're putting your family at risk.

    You don’t need qualified immunity if you follow the rules. Anybody worried about having qualified immunity must be corrupt.
