Assembling to partake in human sacrifices is not covered by the First Amendment to the U.S. Constitution, but conversely, assembling for religious practices (and freedom of expression) is covered. Both can result in death e.g. sacrificing humans and pandemic deaths. Here it a legal excerpt:

    • Is there any historical case law that supports arresting pastors who assemble to practice their religion during a pandemic?
    • Does an executive order (EO) override the Constitution when Martial Law has not been declared?

Here is a 22-second video that shows the NYC mayor giving orders to shut-down all religious assemblies:

This is not about being a pastor, or about religion. This is about the first amendment right to assemble peaceably. It doesn't matter if a group is peacefully assembling to worship God, or to play bingo, they have a first amendment right to do so. And short of Martial Law being declared, no order, local or otherwise, can supersede this first amendment right.

Now, where religion may come into play with this is.... if it's true that any (even one) mosque or synagogue was still having services while the pastor of this Christian church was arrested for having a service.

Nothing prohibits you from doing that. However, the pastor is a controversial holy roller Christian who is a TV magnet -- and hence, the pastor is a lightening rod. An public example must be made of the Christian holy roller because politics are involved. It is the same as putting someone in stocks (for public shaming) in the town square in the 1700s for all to behold:

However, holy rollers don't back-down from religious controversy. That's their playground. The arrest and case is a lightening rod that will still be argued one year from now, long after the pandemic has ended.

The real issue is that cc got his ego bruised when the pastor reminded him that he isn’t bigger than God. It was literally a “Coming to Jesus” moment for cc.
