In a contingent election, the election is placed in the U.S. House of Representatives where each state's delegation has one (1) vote – and a candidate must receive the votes of a majority of state delegations to win.

Because of the timing in the 2020 election, the new Congress is the one that decides, not the outgoing one.

There will be more Democrats in the House, but population-heavy California and New York that are predominantly Democratic in the House will only receive one (1) vote each, just as lower-populated Republican-led states like Wyoming or South Dakota will only receive one (1) vote each. This ensures a Republican majority vote in the House for Trump.

There have been several contingent elections, including 1801, 1825 and 1837, but the most famous contingent election was between Thomas Jefferson and Aaron Burr in 1801, which provided the plot for the Broadway musical "Hamilton."
