Does a City Ordinance outweigh a State Attorney Directive? I don’t want to get in a jam. Seems like City Hall is running the PD again. Ocean Drive needs more than questionable ordinances to get cleaned up. They are trying so hard to not address the real issue that it creates these idiotic ideas.

I’m sorry to point out the obvious. Yes City Hall does run the PD as it is in every municipality in the US. If City Hall didn’t exist then we would not exist either. If that was the case then the County/ Sheriff’s office would police our streets. When the commission creates or amends an ordinance they dictate who can enforce it (parking, code, building inspectors, PD, and so on and so forth). That’s how it works. Same with the County Commission same with our State legislators, all elected officials which create or amend laws. Same as the Federal system. Laws are created and/or amended by the elected officials. The State Attorney (also an elected official) is the Chief law enforcement officer of Miami-Dade. Her job and that of her office is to prosecute all the laws created by all the elected officials within her jurisdiction (to include city’s, town, Miami-Dade and State of Florida. She’s not above any locally elected official nor can she dictate what laws a city can or can not pass. If she or her office believe the law to be unconstitutional then she can bring it to the 11th Circuit Courts for review. That courts decision can be elevated to the 3rd DCA (District Court of Appeals) and that court’s decision can be elevated to the Florida Supreme Court or even to the Federal Supreme Court. As long as the ordinance was created or amended in good faith and there is no preemption from the State, the State Attorney will do her job.

That’s today’s lesson in civics. Now go out there and do the job our City Commissioners, our citizens, and the Chief (our boss) wants you to do. Be safe.
