    Former police captain Jay Rodriguez returns to court for prostitution scandal

    A police scandal with sex, lies, and video tape returns to Lee County courtroom Thursday morning with a critical piece of evidence that was filmed by the accused officer himself.

    The suspect, police captain, Jay Rodriguez, who was arguably the face of the department for years acting as the main spokesman.

    He retired after being arrested back in September.

    City leaders have been extremely critical of the department, but say an overwhelming majority of the officers work hard to keep our community safe.

    He said In Captain Rodriguez’s case, the lie was worse than the offense, and he should have taken responsibility for his actions.

    The case was blown open by surveillance video that shows Rodriguez in a prostitution bust. 6 years later he’s arrested for paying that prostitute then lying about it.

    Fort Myers Police Department is now focusing on two major initiatives to regain trust. The first was the hiring of an inspector general, an outsider who could potentially keep the department in line, and also provide more transparency to the public.

    The second focus is crime prevention. A report recently released highlighted how the department needs to do a better job with communication, and their use of staff to better protect the city.

    Rodriguez is facing charges of misconduct, perjury and prostitution.

    Ex-Fort Myers police Capt. Jay Rodriguez appears in court

    A former Fort Myers police official appeared in front of a Lee County judge on Thursday for a case management conference.

    The appearance lasted less than a minute but marked the first time former police Capt. Jay Rodriguez went in front of a judge after a Sept. 10 arrest, accused of official misconduct, perjury and prostitution.

    Rodriguez was arrested by the Florida Department of Law Enforcement after the agency launched an investigation stemming from the discovery of a surveillance footage taken during a 2013 prostitution sting that purportedly shows Rodriguez engaging in a sexual act with a woman later arrested.

    Rodriguez submitted his resignation letter on Sept. 9, the same day the warrant for his arrest was signed. He spent 20 years with the department and climbed the ranks to become a captain during the last two years of his career there.

    On Thursday, Rodriguez sat stone-faced and watched the proceedings in Judge J. Frank Porter's courtroom before his case was called.

    Rodriguez is to appear in court again on March 10 for a pretrial conference.

    He declined to comment after the case management conference. His attorney, Peter Ringsmuth, declined to comment as well.

    Rodriguez was placed on paid leave after a copy of the video was provided to the city and to The News-Press. Rodriguez, who made an annual salary of $102,000, was paid about $60,000 while he was on administrative leave.

    The prosecution is being handled by a prosecutor from the 12th Judicial Circuit in Sarasota. The case was reassigned to that circuit by Gov. Ron DeSantis after local State Attorney Amira Fox made the request.

    Andrew Van Sickle, an assistant state attorney from Sarasota, declined to comment Thursday after the hearing.

    The prostitution sting occurred in March of 2013 at an Asian massage parlor on Boy Scout Drive and led to the arrest of two women. The woman who appears on screen with Rodriguez had her record expunged. The second woman was arrested for living off the proceeds of prostitution. The case against her was dropped due to insufficient evidence.

    Double d calling for a brass only meeting to rally the troops to try and convince the koolaide chuggers that Jrod wasn’t his right hand man for 2 years and wasn’t running the department. This looks bad on double d the 180k Chief

    I don't know if JRod got people needlessly in trouble. My experience with him, only in passing, was that he was a friendly guy who seemed a lot less insecure and nasty than many people that we run into in this world. There are many people whose lives he touched, no pun intended, who still think of him kindly and appreciate his service. We should not be judged by our worst moments and if this was his then there will be life after FMPD. Presidents have plead guilty of DUI. military leaders have been discredited and gone on to win wars, the list goes on. Someone was even foolish enough to hire top cops around here after being run out of town from their home departments. JRod was our brother for many years. If he screwed people over that I don't know about, I'm sure the trolls will fall all over themselves to fill us in on the details, but what I know/remember of him was someone that tried to big people up rather than only cut them down. Perhaps it wasn't genuine but at least it was a start. It is sad seeing him up there today. If all of our worst moments were put on blast by the news press we would have about 5 people still employed. I hope JRod can follow his better angels and make a contribution to society and overcome this. God's speed and good luck.
