FMPD Captain filed report of extortion against community activist

FORT MYERS, Fla. -- The state investigation into Fort Myers Police Captain Jay Rodriguez is heating up.

Fox 4 learning Rodriguez is now accusing a Fort Myers man of extortion.

All this related to video allegedly showing Rodriguez engaged in a sex act during a prostitution sting back in 2013.

Captain Jay Rodriguez filed the report February 11th, a day after fox 4 we received the video.

But the report explains the incident surrounding claims of extortion occurred 2 months ago at a city council meeting.

“They were supposed to be doing undercover operations, but weren’t keeping any receipts,” said Anthony Thomas, Jr.

That’s community activist Anthony Thomas speaking at a Fort Myer’s city council meeting during public comment back on December 3rd, 2018.

Fox 4 reported on this meeting because his comments sparked members of the city council to get in to a heated discussion, over the performance of the police department.

“Before you can move forward you have to go back and make some amends,” said Councilman Johnny Streets, Fort Myers.

This is the same meeting Captain Rodriguez claims statements were made implying extortion related to this video of Rodriguez allegedly involved in a sexual act during an undercover prostitution sting.

Thomas confirmed to Fox 4 he is the man at the center of Rodriguez’s extortion claim.

In the report Rodriguez explains Thomas said "and the rest of them are going to have it too, if you don’t pay."

“At no time and at no place have I ever tried to get money from Jay Rodriguez,” said Thomas.

We obtained a copy of Captain Jay Rodriguez's personnel file from FMPD.

During his 2013 review, one comment said "all written reports are clear and concise."

It also states, "Rodriguez makes decisions based on facts and information....his decision making process is highly ethical."

The sexual misconduct allegations against Captain Jay Rodriguez took place this same year.
