    FORT LAUDERDALE, Fla. (AP) — Attorneys for a former Florida sheriff’s deputy want a judge to dismiss felony charges stemming from his failure to enter a school building while a gunman carried out a massacre.

    Scot Peterson's attorneys say prosecutors stretched the laws "beyond their breaking points" when they charged him last month with child neglect, culpable negligence, and perjury for his actions during and after the 2018 shooting at Marjory Stoneman Douglas High School that left 17 dead and 17 wounded.

    Attorney Joseph DiRuzzo III wrote in filings filed last week that while Peterson was the deputy assigned to the school, he was not the students' legal caregiver. He also wrote the Broward Sheriff's Office's policy for confronting active shooters said deputies "may" enter a building, not "shall."

    Prosecutors have not responded in court.

    Israel was and is a cowardly scumbag. He appointed Jordan as Captain and hooked up many incompetent arseholes that contributed to deaths and crimes. He totally focked up the jail. The only thing he ever did in his law enforcement career that I remember was steal cologne from the Galleria! You beat that one big ears, but you won’t be Sheriff again.     Peterson's attorneys are totally right.

    Peterson was not a caregiver for the students. He was a LEO, who worked for an agency other than the one which actually held the position of care giver to the students, the School Board of Broward County. So, those counts are spurious. The counts of culpable negligence all hinge on the theory that if he had entered the building immediately, none of the injuries or fatalities, which occurred after his arrival, would have occurred. This is pure speculation. And, it flies in the face of several high federal court decisions which state that individual LEOs have no duty to protect individual citizens. There is no evidence to support the counts based upon these two statutes. It is incredible that any judge signed off on them. The only charge, which has any credibility, is the perjury charge.
