You have to have DOJ along with the USSAO do a civil rights investigation against everyone involved. This is a major corruption case. The people that caused this accident are the one that investigated it.

    How many cops have gotten into motorcycle accidents? A few loved the rockets. No one deserves to die and no one deserves to be attacked on social media after losing a loved one.
    You guys need to stop following losers that have claimed to have fallen asleep in the back seat of random dope dealers cars or the other fool that attacks woman and kids at music festivals. We have hit an all time low

    No matter if we were or were not doing a traffic detail and try to stop him. The idiot on the motorcycle just had to stop, but no he took off speeding. He was in charge of his own destiny.     Lost to you is the fact we are police officers, sworn agents of a Municipal entity operating under Color of Law. The traffic violator who fled at a high rate of speed was not duty-bound by the legal constraints police officers are; that is why he was violator. The police vehicle seen “following” the traffic violator at an exorbitant speed was operated by police officer, who knew or should have known the Department Order governing pursuing traffic violators. Such are rooted in legal precedent; most saliently City of Pinellas Park v. Brown, Supreme Court of Florida, July 23, 1992. Below is the case most pertinent paragraph. Perhaps the City Attorney should revisit and impart its guidance in the form of a reissued Legal Note.

    “We do not suggest, however, that the police must allow every lawbreaker to escape merely because a hot pursuit is occurring. Deference will be shown to the reasonable decisions of law officers to maintain pursuit of certain offenders who are reasonably thought to be violent or to pose a danger to the public at large. What is required is for police to use reasonable means in light of the nature of the offense and threats to safety involved. For example, a high-speed chase is likely to be justifiable if its object is a gang of armed and violent felons who probably will harm others. As we have stated elsewhere, deference will be shown to police conduct when officers must choose between two different risks that both will adversely affect public safety.”

    By persisting in pursuing the traffic violator, apparently unannounced over the police radio, as otherwise a supervisor would have, SHOULD HAVE ordered the chase terminated, the involved officer assumed ALL responsibilities for the disastrous consequences and through vicarious liability the City Of Miami.

    Mayor Francis Suarez, you and City Manager E. T. Gonzalez have a duty to correct the situation and you can do so by having MDPD Traffic Homicide Unit detectives or FDLE, in concert with FHP Traffic Homicide investigators examine whatever evidence, testimony and all pertinent matters concerning this case that may still remain. Then, upon concluding the investigative part, investigator will present their findings to the State Attorney’s Office; wherein the Office’s most experienced Traffic Homicide Prosecutor will evaluate the findings and determine whether or not there is probable cause to arrest and if applicable, prosecute.
