On April 13, 2018, the Miami New Times published a story titled, "Miami Police Captain Javier Ortiz Cuts Ads for Anti-Aging Clinic with Chiropractor tied to political scandal." Captain Ortiz made an advertising video for promoting a private business, Body RX, which is an anti-aging clinic that offers testosterone and other hormone treatments. This case was closed as a no finding.
Complaint:
On December 18, 2019. The CIP voted to self-initiate a complaint in order to investigate under the county, and city ordinances. The questions posed by the Panel included the following:
1. Did Captain Ortiz violate any city ordinances?
2. Did Captain Ortiz violate any county ordinances?
3. Did Captain Ortiz violate any Departmental Orders?
Investigation:
CIP staff attempted to view Instagram account javifop20 and found the account is private.
CIP Staff reviewed the Facebook page and website of Body Rx. The Facebook page contained several photos of Javier Ortiz. There is nothing indicating he is a police officer and nothing pertaining to the City of Miami police department. The website contained a video testimonial featuring Javier Ortiz. In the video he identifies himself as the president of the FOP and says he represents police officers. He does not say he is a police officer nor does he mention which police department he represents.

CIP staff requested any documentation allowing Javier Ortiz to act as a representative for Body RX and received a response that the request had been forwarded to the legal department. Several updates were requested and each response stated the request was with the legal department. Miami Police Department Legal Advisor George Wysong advised he has not seen any such documentation.
CIP staff reviewed the Miami New Times article dated April 13, 2018. In the article Javier Ortiz says he's not compensated for the ads and he has referred cops to the clinic only for healthy diet advice. He's quoted as saying "Body Rx offers advice under medical professionals to give our FOP members the opportunity to improve their health through fitness plans, proper eating habits, and close monitoring of their personal health."
CIP staff reviewed the Miami-Dade County Ethics Code. The Ethics Code addresses Exploitation of Official Position by prohibiting any special privilege or exemption that is obtained by use of official position. The Ethics Code addresses prohibited gifts by stating, requesting or accepting gifts intended to persuade an employee to take or not take an official action or to perform or not perform a duty required by their government service.
CIP staff reviewed the Departmental Orders and found it's only a violation of policy if the department member or civilian employee identifies himself/herself as being affiliated with the Police Department, or his/her official title in connection with testimonials or advertisements of any commodity or commercial enterprise.
An email was sent to Chief Jorge Colina to determine if he or anyone in his command staff authorized Javier Ortiz to act as a spokesperson for Body Rx. An email was received from the Chief stating he never authorized it and he is not sure when the video was created so he is not sure he was the Chief of Police at the time.
CIP staff requested copies of all outside employment forms submitted by Captain Ortiz since the beginning of his employment with the Miami Police Department. A response from the City Clerk stated there are no outside employment forms in Captain Ortiz’s personnel file.
The Independent Counsel authored a letter to Body Rx to obtain any records of payment, either monetary or in services, to Captain Ortiz. Independent Counsel John Quick spoke to Body RX Proprietor, Steven Sevilla and his Attorney Christopher Lyons. Mr. Sevilla and Mr. Lyons advised no one, including Captain Ortiz receives any form of compensation (whether monetarily, through reduced cost or complementary services) in exchange for providing a testimonial. Compensation as discussed in this context refers to any money, gift, favor, thing of value, or financial benefit conferred in return for services
