To answer your question, yes, belonging to the Nazi Party, the Democratic Party and the Republican Party are all First Amendment rights. What rights are guaranteed under the First Amendment? Specifically, it means that the government cannot arrest and incarcerate you for being a member of the Nazi party. However, you are not guaranteed employment and your employer may legally fire you for being a member of the Nazi Party.
First Amendment Recap:
- You are protected from arrest and incarceration by the government.
- You are not protected from being terminated by your employer.
Many people incorrectly associate free speech with employment rights.

The SCOTUS has consistently ruled that so called hate speech is protected under the first amendment. Research it.

It’s true that quote unquote hate speech is due first amendment protection, the problem is it’s rarely just that. It tends to cascade into other things that border incitement and fighting words etc.
It’s semantics to say hate speech is protected until it rises to the level of words that incite a person to immediate violence as is often the case.
Walking in a nazi parade and yelling white power is afforded police protection. But inciting people with that same message by disparaging their race or religion is not. The two are considered mutually exclusive but in reality it usually doesn’t work that way.
Look the real question is whether it is appropriate for a law enforcement official to harbor such views. That’s not a legal question, it’s a moral question, and I won’t pretend for a second it’s not an embarrassment for such views to come to the public’s attention. It is, plain and simple, an embarrassment.
