    Check your facts before making criminal allegations against anyone

    This is going to be kept as short and sweet as possible. I'm not choosing sides or picking a fight. I am however going to encourage anyone that wishes to speak at an open forum to take a few minutes and do some fact checking. Especially, if you are going to call ANYONE out and accuse them of committing a crime. Mayor Porter was accused of being "Extremely Fraudulent" by his failing to comply with the Resign to Run Law and his actions equivalent to some kind of Parlor Trick. There are legitimate ways to confirm information but just in case, please read below. Unless there was a horrible misunderstanding or simply an oversight, Mayor Porter deserves an apology.

    RESIGN-TO-RUN LAW – GENERAL OVERVIEW  Governing law: An elected or appointed “officer” may not qualify as a candidate for another state, district, county or municipal public office if the terms or any part of the terms would overlap with each other if the person were to be elected or appointed and did not resign from the office the person presently holds. (s. 99.012(3), F.S.)


     How to submit a resignation: o In writing at least 10 days prior to the first day of qualifying for the office the officer seeks. (s. 99.012(3)(c), F.S.) o Submitted to:  For elected district, county, or municipal officers:  To the officer before whom he or she qualified for the office he or she holds,  Copy to the Governor and the Department of State.  For appointed district, county, or municipal officers:  To the officer or authority which appointed him or her to the office he or she holds  Copy to the Governor and the Department of State.  For all other officers:  To the Governor  Copy to the Department of State. (s. 99.012(3)(e), F.S.)


    1 Florida case law further explains that an “officer” is someone who exercises sovereign power, in part or wholly, either in making, executing or administering the laws and who derives his or her position from a duly and legally authorized election or appointment, whose duties are continuous in nature and defined by law, not contract. See State ex rel. Holloway v. Sheats, 83 So. 508, 509 (Fla. 1919). And see State ex rel. Clyatt v. Hocker, 22 So. 721 (Fla. 1897).
     Effective date of the resignation: The resignation must take effect no later than the earlier of the following dates: o The date the officer would take office, if elected; or o The date the officer’s successor is required to take office. (s. 99.012(3)(d), F.S.)
     Resignation is irrevocable. Once submitted, the resignation is irrevocable (s. 99.012(3)(b), F.S.)

    No worries.. Those who know the man knows he’s a Stand Up guy. Those that spit the negativity should look in the mirror. Haters and the envious are all around.

    If he loves this place so much why did he step down/out to run for Agg. commissioner? Just like GG, I’m leaving, no I love this place it’s where I’m suppose to be, oops outta here...."

    JP was trying to move forward in his political career. Just because it was ag commissioner does not mean he would not have made moves and decisions in south Florida or Homestead area. He would have been able to possibly have a bigger influence and potential not only state wide but Homestead as well.

    Maybe instead of the small handful of people bit*!?€# about the city manager the rest of us (majority) should have spoke out about the dam good job he has done and continues to do. Maybe he would stay or consider staying. Do some research people...... one of the best if not the best the city has had.

    Yep he would have done so much for Homestead, because we have so many farm fields left in the city limits. Yeah right!!!!!

    AG Commissioner has a lot of other involvement than just farm fields. Research before you comment

    Porter done more than some of these other mayors that have come and gone. Seems genuine and legit

    Yeah. I’m with Porter and Roth They have done way more fore this city, the citizens and charities than Losner and Rea. The proof is in the facts. Words don’t mean crap, actions are everything.

    Is this directed at the criminals within the department who falsify arrest reports, or are you all cool with that?

    All these claims of corruption and criminals within the City Government and Police Department. PROOF? 🤷🏻*♂️🤷🏻*♂️🤷🏻*♂️🤷🏻*♂️
    All talk. There is FDLE, FBI, DOJ. Their doors are always open not locked. There is a difference between “accusations/claims” and “Tangible FACTS”.
