    Fraternal Order of Police Hollywood-Lodge 24
    Informational Sheet
    Fraternal Order of Police Lodge #24 is a local police union comprised of active Hollywood Police Officers only. Due to the recent interest in Officers joining the FOP, this fact sheet was compiled to answer questions. The FOP representation model puts 100% control in the hands of the active members. Officers have the opportunity to control all of the business of the local lodge. Under FOP, each local lodge decides for itself whether to engage in collective bargaining, legal defense, or function solely as a social, professional organization. Many lodges do both. However, this choice is left strictly to the members of each lodge with NO interference or decision-making by a county organization, State Lodge, National Lodge, or members from other agencies.
    Question #1. Who can I choose to be the FOP#24 Executive Board?
    FOP: The board is comprised of the President, Secretary, Treasurer, Trustee etc. Everyone on the board is an active Hollywood Police Officer. Voting takes place every two years for President, Secretary, Treasurer, etc. All members are eligible to run for an elected office that are in good standing. If the active membership approves of their performance, the membership re-elects the individual to another term. Should the membership not be happy, the membership can vote them out. Lodge #24 also allows the membership to vote and select their own the representatives.
    PBA: The Broward PBA Executive Committee are selected and voted on internally. General PBA members cannot vote for or against any member of the Executive Committee. Currently, zero members of the Executive Committee work for the Hollywood Police Department. They are a retiree, Coconut Creek Police Officer, Pembroke Pines Police Officer, and a Broward Sheriff’s Deputy. The PBA claims members have the right and freedom to choose their representatives. According to Section 2 Page 5 of the Broward PBA By-Laws, “All Membership Representatives defined and set forth in Section A above, will be elected by the membership from the individual agency either by a mail-in vote or by an on-sight election.” Clearly from the last two appointments, this is not the case.
    Question #2. Legal representation is very important to me. How does it work with FOP#24?
    FOP: The FOP model gives the local lodge/membership the option to choose the legal representation best for them. The first option is contracting legal representation though the State FOP, called a Labor Council. The Labor Council provides full service union representation in negotiating and enforcing union contracts, improving salaries, working conditions and benefits for law enforcement professionals throughout Florida.*FOP members are protected 24 hours a day by a staff of 7 full-time field representatives, General Counsel and attorneys and staff members who have the best proven track record of winning. The Labor Council represents law enforcement professionals exclusively and full-time. An alternative is to contract legal representation though the local lodge. Attorneys well versed in criminal defense, labor law, contract negotiations, grievance and arbitration procedures, and collective bargaining lobby the membership to be retained by the lodge. The lodge vets and verifies the ability of each attorney based on performance, member feedback, member testimonials (including other agencies), outcomes, and resolutions. That attorney is then presented to the membership, voted on, and then contracted on retainer. If the membership is pleased with the attorney’s performance, he/she is retained as legal counsel for the lodge. Should this not be the case the membership votes to terminate the contract and resume the process with a new attorney.
    PBA: The attorneys representing the members of the PBA are chosen by the President. PBA members have no vote as to what attorneys are being hired, retained, and utilized, only the executive board has input. Should the members raise issue with a PBA attorney, the PBA president, at his leisure, can hire a different attorney. Since the President is not voted in or out by the membership, the decision is solely his with no repercussions for poor representation. Article 7, Page 5 Broward PBA By-laws. The president with the advice and consent of the Executive Committee shall hire and assign all employees and attorneys of the Association, and shall fix their compensation and other benefits and approve their expenses. He/she shall be empowered to grant such employees and attorneys binding employment contracts on behalf of the Association with the advice and consent of the Executive Committee, not to exceed three (3) years. This leaves the membership with three options. One, to tolerate the substandard legal representation, acquire your own attorney paying them privately, or switching to a union which puts the power in your hands.
    Question #3. What is a bargaining unit and how can the FOP become one for Hollywood?
    Each police agency only has one bargaining unit, elected by the members. Since the Florida Constitution allows workers to negotiate contracts as one large unit (collective bargaining), this unit negotiates contracts for all officers. Not just the officers in the same union as the bargaining unit. The bargaining unit also represents all members, regardless of what union you belong, in matters such as grievances and labor management issues. It is illegal for a bargaining unit to unevenly represent a member based on his union membership.
    For the FOP to become the bargaining unit in place of the PBA, 30% of the membership must fill out interest cards. It does not matter what union you are apart of to fill out interest cards. The signed cards are then sent to PERC (Public Employees Relations Committee). PERC verifies that 30% of the bargaining unit are interested in holding a vote. The Public Employees Relations Committee will come to the city to conduct an official vote. At this vote, if 50% plus one officer vote for the FOP, then the FOP becomes the bargaining unit for the Hollywood Police Department. This can only be done on two occasions. The first is when the City and Collective Bargaining unit do not have a signed contract, as we are currently working under. The next is a 30 day window at the end of a signed contract period.
    Question #4. You mentioned contract negotiations and collective bargaining. Who is our negotiator(s) and can they be changed?
    FOP: The chief negotiator would be the President of FOP#24. The President is selected by the members by vote. Additional negotiators would be selected by the membership based on input and experience. Contracted legal counsel would also be present during negotiations. The membership would have control who is negotiating the contract. The membership also has recourse should the negotiation team perform poorly. This is to vote them out.
    PBA: Per the collective bargaining agreement that expired on September 30, 2017, the chief negotiator is the PBA President. Officers are unable to select who they want as PBA President. Other negotiators are the PBA representatives. More importantly, the contract negotiated by the Chief Negotiator has zero impact on his pay, benefits, work conditions, or quality of life, since he does not work for the Hollywood Police Department.

    Question #5. What negotiating team would be better for me?
    FOP: FOP #24 negotiators would be made up of all active Hollywood Police Officers. People fight harder for something that directly affects them. Every officer negotiating a contract would then have to live/work under that contract for the duration. All members of the negotiating team work with members of the bargaining unit daily. This model allows the negotiation team to know more specifically what to bargain for in negotiations. All members would have direct access to every member of the negotiating unit daily, you see them in the hallways, you are on calls together, you attend training together. This allows all of the membership to express directly what they would like to see in negotiations.
    PBA: Currently, the chief negotiator, the PBA President, is a retired Hollywood Officer. He does not work under the contract he is negotiating for the members. He does not work with the officers he is bargaining for. If things go poorly, the membership has no recourse to replace the president in accordance with the contract. The PBA has no plans to modify this provision in the contract. Many members have expressed their displeasure with their voices going unheard or many times, not even consulted as to what their union should bargain for. Must a Union Be Run as a Democracy? Yes. The Landrum-Griffin Act insures all union members a voice in the affairs of the union. Employees have complete freedom to "express any view, arguments, or opinions" at union meetings or functions without punishment. This includes the right to hand out leaflets to other union members or to seek publicity, as long as the union member doesn't advocate supporting a rival union or breaking the contract with the employer. Freedom of assembly is also protected. Union members may meet outside of regular union meetings and discuss union affairs without fear of reprisals from union officials.
    Question #6. Doesn’t all of this talk about switching unions make us look weak to the city, especially during negotiations? Wont we get a poor contract if we switch?
    FOP: The FOP model of representation gives the membership a stronger bargaining position. This is due to the fact that each member of the negotiation team is an active police officer for the city. The city is well aware that all members of the negotiation team are answering their 911 calls, coming to their houses for issues, commanding units, and serving their voters. The city realizes the all active negotiating team understands what is going on in the agency, and has the pulse of the membership. This is due to the close working relationship the team has with the members. The membership also understands that they serve the citizens who are taxpayers to the city. This gives both parties a vested interest to negotiate well with each other and to make long lasting, positive relationships. This is specifically imperative that the chief negotiator be an active police officer.
    PBA: Under this model, the Chief negotiator is the PBA President. The PBA does have representatives (some elected by the membership, some not) present. They, with exception of the chief negotiator, are active members. The same chief negotiator collectively bargains the contracts for Hollywood, the Broward County School Board, Pembroke Pines, Lauderhill (lieutenants), Sunrise (lieutenants), Sea Ranch Lakes, Lighthouse Point, Wilton Manors, Margate (lieutenants and captains), Miramar, Coconut Creek, Hallandale Beach, and Hillsboro Beach. Can the PBA expect that the chief negotiator has the pulse of the membership for all of these agencies? Can the membership of all these agencies expect the negotiator to fight equally hard for each one of them better than one of their own active members? This is a detriment to the membership.
    Question #6. If the FOP model is so good at bargaining, what have they done lately for the officers they represent?
    FOP: The FOP has collectively bargained under this model, with 100% active negotiators the contracts for Boca Raton PD, Coral Springs PD, Sunrise PD, Fort Lauderdale PD, Plantation PD, and Davie PD. Although economic factors play a role, these agencies are some of the highest in the tri-county area. The City of Miami which is represented by the FOP, was involved in financial urgency in 2010. That all active negotiating team put in their contact, 2015-2018 Section 45.6 “The parties acknowledge the FOP has a legal challenge (or challenges) to action taken by the City in 2010 as a result of an invocation of financial urgency. This contract will not be evidence of nor asserted as a waiver of the ability to maintain those legal challenge(s). If successful, the FOP would be entitled to the remedies available under applicable law. This shall not constitute a waiver of any legal right or recourse on the part of the City to address any reward of a remedy.” The FOP won the case and now all City of Miami officers are entitled to any pay/benefits remedy allowed by law.
    The 2015-2018 Sunrise Police Officer/Sergeant contract is negotiated with the FOP. Wages were increased by 2.5%, 2.5%, and 1.5% each year.
    PBA: Currently the City of Hollywood is without a contract, again. The contract expired October 1, 2017. The last contract was ratified October 9, 2015 forcing the Hollywood Police Officers to work without a contract for a year. The Broward PBA has collectively bargained the contracts for Hallandale PD, Pembroke Pines PD (FRS), Miramar PD. The City of Hollywood illegally invoked financial urgency on the members in 2011, the Hollywood Police Department is represented by the PBA. In the 2012-2014 contract section 37.9 and 2014-2017 contract section 37.6 “The Union agrees for itself and for all bargaining unit employees to waive, renounce, and forgo any and all remedies and payments whatsoever related to the modifications to any part of the Collective Bargaining Agreement or the Pension Plan Ordinance made by the City pursuant to financial urgency to which it or they are or may become eligible to receive, whether resulting from an award by any tribunal or through settlement of any matter related to such changes, including the pending unfair labor practice charges that are on appeal in Case Number 1D12-3901 and PERC Case No. CA-2011-098 and/or the unfair labor practice charges that are stayed in PERC Case No. CA-2012-216.” After the Miami FOP won the case, this waiver does not entitle any Hollywood Police Officer the pay/benefits remedy allowed by law.
    Same situation, two different unions, two completely different outcomes. All members of FOP negotiating team ultimately benefited from this. One person from the PBA negotiation team that was not adversely affected, PBA President Jeff Marano.
    The 2015-2018 Sunrise Police Officer/Sergeant contract was negotiated by the FOP. Wages were increased by 2.5%, 2.5%, and 1.5% each year. This same contract year with the Sunrise Lieutenants was negotiated by the PBA. The PBA only secured a 1.5% wage increase the last year of the contract with the same city, same police department, same time frame.
    Question #7. How much does each union cost me?
    FOP: $600.00 yearly.
    PBA: Broward PBA $675.48 yearly, Hollywood PBA $156.00 yearly. $831.48 total.
    Question #8. Well if the problem with the PBA is the model, why doesn’t the PBA just change their model like the FOP?
    PBA: The Broward PBA currently believes that one president being chief negotiator for 13 separate agencies, selecting and retaining legal counsel in the best interest of those 13 agencies, is the best most effective way to represent the membership. Many members from these 13 agencies have voiced the same concerns. Concerns that the membership is not being consulted in contract negotiations, lack of communication between the representatives and the president. The inaction on the part of the PBA in filing grievances for the benefit of workplace conditions. This has caused agencies such as the Broward Sheriff’s Office, the Davie Police Department, and in Miami-Dade, the Hialeah Police Department to recently leave the PBA for the FOP. Miramar, Pembroke Pines, and Hallandale have expressed displeasure with the PBA as well. Still, the PBA has no intentions of changing this model.     Question #9. I talked to a friend of mine in Davie, he said the FOP state legal isn’t that good. Can you explain this?
    FOP: The Davie Police Department has the same structure as all FOP local lodges, 100% controlled by active members. However the membership decided to retain state legal services from the FOP Labor Relations Board. This board was implemented to give smaller agencies with little funding legal representation. This board is comprised of retired police officers to serve as representatives. Should a member request legal services, the Labor Relations Board sends the member a representative, not an attorney. These representatives are assigned and not selected by the membership, each with different levels of experience. An attorney would be assigned for a more serious matter. Some FOP Lodges are not pleased with this model. Coincidentally, this is the same model used by the PBA except more localized. Hollywood FOP Lodge #24 has taken proactive measures to give their membership the highest quality representation by retaining an experienced private attorney.

    Question #10. What are some other differences between the PBA and FOP?
    FOP: The FOP believes union membership is an individual decision. Your membership in one union or not has zero effect on the other. The FOP strongly encourages each officer to do what is best for himself/herself, your career and family depend on it. The FOP also believes that the union should be controlled by the active members. The officers that are affected by representation and contracts should be the same officers who have a say and decide what is best for them. The FOP can be as strong or weak as the officers want. It’s 100% up the Hollywood Police Officers for better or worse.
    PBA: The Broward PBA believes that a President, overseeing multiple agencies, can efficiently and effectively represent each agency with 100% undivided attention. This model shows the PBA President knows what’s better for your agency and your members, more so than active working cops. The Broward PBA believes they can defend the membership, grieve poor working conditions, or negotiate a contract better than active members.

    From the Broward PBA blog concerning negotiations taking place June 5, “Just received a call from ACM Keller, who advised the city was in receipt of the pension restoration costs from their actuary. After meeting with the CM, Keller advised the restoration is not affordable. For those of you who were going to attend and expected something positive, I apologize.”
