On Tuesday, July 10, 2018, at approximately 7:00 p.m., while off duty and in plain clothes, you were observed entering the "Hole in the Wall" restaurant, located at 8002 SW 81 Drive, Miami, Florida. As you entered the restaurant you were observed by the complainant, Mr. Hunter Rogers, wearing your County issued badge and a holstered firearm in plain view of all of the restaurant patrons. The restaurant security footage showed that while inside, you ordered food and a beer, and began drinking the beer while still wearing your badge and firearm, which clearly identified you as a law enforcemen·t officer. You were then told by the management of the restaurant that your actions alarmed the staff, and they requested for you to conceal your firearm. You were then observed placing your holstered firearm on the counter, after removing it from your hip to adjust your belt. You then walked outside the restaurant with the firearm, returning a short time later without it. At approximately 7:14 p.m., you were observed identifying yourself as a police officer to a patron seated to your right, exposing your County badge and quickly showing it to him. You proceeded to grip the glass of beer in front of you, and hold it to your lips while in conversation with the patron.
