    OnMarch29,2018,the Charlotte County Sheriffs Office Internal Affairs Unit initiated
    aninternal investigation on Deputy First Class Justin Treworgy, hereinafter "DFC
    Treworgy," on charges related to Violation of Procedures or Directives (Endangering
    persons or property) - Drug free workplace under Charlotte County Sheriffs Office
    Operations Manual G.O. 3.50F (4) b(2).
    This investigation stems from allegations DFC Treworgy tampered withtwo drug tests
    while employed at the Charlotte County Sheriffs office along with evidence a
    a
    controlled subs tanc e und e r Flor id a Sta te Sta tute 893.13.
    Prior to being served with notice of the internal affairs investigation, DFC Treworgy
    submitted an inter-office memorandum resigning from the Charlotte County Sheriffs
    Office.
    OnMarch9, 2018, DFC Treworgy was selected to participate ina random drug test in
    compliance withthe Charlotte County Sheriffs Drug-Free workplace police, G.O. 3.45
    and Florida State Statute 440.102. DFC Treworgy was provided with notice voluntarily
    consenting to submit a urine/blood specimen, under the direction of medical or
    Laboratory personnel.
    OnMarch 12, 2018, the Charlotte County Sheriffs Office received notification from
    the facility used to facilitate the drug test, indicating two test samples were
    received from DFC Treworgy on March9, 2018, and bothtest had yielded a
    result for the presence of the following narcotics; Amphetamines, Barbiturates,
    Benzodiazepines, Cocaine, Marijuana, Metab, Methadone, Methaqualone, Opiates,PCP,
    Propoxyphene.
    The receipt of two Drug test reports from the same member, conducted onthe same date
    concerned Heather Lupinetti, the Charlotte County Sheriffs Office Human Resource
    Supervisor.
    On March 14,2018, Heather Lupinetti (hereinafter "Lupinetti") contacted inan
    attempt to inquire into why there was two tests conducted onthe same member onthe
    same day. Lupinetti spoke withDavid Perillo a Radiology Technician, who informed her
    onMarch9,2018,DFC Treworgy had provided a urine sample for a random drug test.
    The sample was given to Brianna Scimemi, a registered nurse employed by
    The initial sample failed the temperature testing strip test; indicating the sample was
    outside the range of 90-100 degrees Fahrenheit. A subsequent test was requested from
    DFC Treworgy.

    Lupinettiwas informedby David Perillo,he attempted to observe the subsequent test,but
    DFC Treworgy blocked his view and would place his hands inhis pocket,out of view of

    Lupinetti was informed the sample was againtested witha temperature testing strip
    whichinitially indicated the sample was withinrange,but quickly dissipated.
    As a result of DFC Treworgy's behavior, indicative of an individual's attempt to tamper
    witha drug test,along withhis significant deteriorationinwork performance and in
    compHantwithFlorida State Statute 440.102,DFC Treworgy was requested to participate
    ina reasonable-suspiciondrug testing.
    On March 15,2018,DFC Treworgy was provided withwrittennotice of the request. The
    notice provided the request was based onreasonable suspicionand depicted facts upon
    which the inference was based upon. DFC Treworgy was placed on administrative duty,
    pending the results ofthe drug test.
    OnMarch21,2018, DFC Treworgy reported to
    where the test was conducted. This test, unlike the
    two prior submissions,involved the submissionofa hair specimen.
    Following the hair submission, on March 29, 2018, DFC Treworgy submitted an inter
    office memorandum expressing his immediate resignation from the Charlotte County
    She r iff's Offic e .
    Following the resignation,the Charlotte County Sheriffs Office received notification
    from via a medical review officer final
    report, indicating ttie test specimen provided by DFC Treworgy on March 29, 2018,
    resulted in a a controlled

    Human Resource supervisor, Heather Lupinetti provided a sworn taped statement
    supporting the above facts.

    At the time o f this' incident, DFC Treworgy was a sworn certified law entbrcement
    member assigned to Road Patrol. Additionally,DFC Treworgy was a member of the
    Charlotte County Sheriffs Office Clandestine Laboratory Investigations Team, subject to

    The purpose of General Order 3.45 is to establish a drug-free workplace and promote
    members healthand safety along withthe security of the workplace.
    The policy states inp ^ :
    The Sheriffs Office prohibits the manufacture, distribution, sale, possession, use or
    abuse of illegal or illegally obtained drugs or abuse of legally obtained drugs or alcohol
    inthe workplace. The Sheriffs Office discourages drug abuse by members under any
    conditionon the basis that it is detrimental to healthand safety. Inthis regard, members'
    attentionis called to the Sheriffs Office Statement of Policy ona Drug-Free Workplace.
    The Sheriffs Office will take appropriate and reasonable measures in accordance with
    applicable law and this policy to eliminate workplace risks caused by drug abuse. These
    measures may include disciplinary steps up to and including termination of
    employment/appointment and charges for possible criminal.prosecution.
    B. Illegal Drug Prohibition
    1. The Sheriffs Office strictly prohibits the manufacture, distribution, sale, possession,or
    use of illegal or illegally obtained drugs in the workplace. The possession, use or sale of
    unlawful drugs is forbidden to all members,regardless ofwhether suchuse, possessionor
    sale occurs onor off duty and will result in disciplinary action. Illegal dhigs are those
    whichare described under Chapter 893 of the Florida Statutes.

    Throughout the first week of April, I called Treworgy's cell phone inan attempt to speak
    with him regarding this incident. The number I called was . On every one
    of these attempts, I received a voicemail. The person onthe voicemail identifies himself
    as Deputy Justin Treworgy with the Charlotte County Sheriffs Office. I recognized the
    voice to be that of DFC Treworgy. I left several voicemails requesting a callback. As of
    April 11,2018,1 have not received communications form DFC Treworgy.

    During the course of this mvestigation, I reviewed the inter-office memorandum
    submitted by Heather Lupinetti, the documents related to the drug test process, the
    medical review officer's find report, Ch^lotte County Sheriffs Office General Order
    3.50 (the policy governing guidelines for Appropriate Conduct/Disciplinary Procedures)
    and Charlotte Coiinty Sheriffs Office General Order 3.45 (Drug free workplace).
    The facts of this case indicate DFC Treworgy was randomly selected to submit a urine
    specimenin accordance withCharlotte County General Order 3.45. During the course of
    this submission, DFC Treworgy exhibited behaviors which raised suspicion as to the
    validity ofhis urine submission. Based onthis informationand DFC Treworgy's behavior

    inthe workplace,the Charlotte County sheriff's Office developed reasonable suspicionto
    believe DFC Treworgy was inviolationofthe Sheriff's Office policy ondrug usage.
    DFC Treworgy was sent for a follow-up drug test which yielded a
    controlled substance.
    In conclusion, this investigator finds there is a preponderance of evidence to indicate
    Deputy First Class Justin Treworgy violated Charlotte County Sheriff's Office General
    Order 3.45 - Drug-Free Workplace and as a result, the charge of Violation of
    Procedures or Directives (Endangering Persons or Property) is sustained.

    Deputy racks up salary while under state investigation

    A Charlotte County Sheriff’s Office sergeant has been paid $29,754 — while on administrative leave — after the Sheriff’s Office learned he was under investigation by the Florida Department of Law Enforcement last October.

    James White, hired in 2003, was promoted to sergeant last year, serving in the Intelligence Unit.

    The Sheriff’s Office has not provided any additional information. Radio Host Ken Lovejoy has spoken on air about an alleged steroid investigation involving White during his show Charlotte County Speaks. Contacted by email, Lovejoy said his information comes from current and former law enforcement officers. None were willing to speak on record with the Sun, but Lovejoy said no one from CCSO has yet contacted

    him to tell him he’s wrong.

    “When requesting info from CCSO, I ask for the status of Sgt. James White’s steroid investigation,” he said. “They would only say he was still on paid admin leave and that the investigation was turned over to FDLE. They didn’t deny that it was for steroids.”

    Asked whether she could confirm the investigation involved steroids, FDLE Spokeswoman Jessica Cary said, “No, we cannot provide any information at this time.”

    After six months, and several thousand dollars, it’s unclear how much longer the investigation will take.

    “To my knowledge we have not been contacted by FDLE in regards to the conclusion on their investigation,” said CCSO Public Information Officer Katie Heck.

    Charlotte county deputy thief

    A Charlotte county deputy who no longer works there due to his drug use and buying prescription pain pills arrested me July 2017 and he was out for blood I’ve never been in trouble I was honestly at wrong place wrong time. I never got my iPhone 6 back or my DL or my prescription I legally have! My word against a cops well we all know I lose on that one! I’m out thousands of dollars and all the other bs that comes along with being arrested I’m no angel but I didn’t deserve to be arrested then robbed by the scumbag that arrested me!
