That will come into play on this one.
It's an odd case because it has Knight's nuthouse politics mixed in with it. That's why everyone is watching it.

Lightbulb Pre-trial diversion for alleged commission of felony?

Journalism can never be silent: that is its greatest virtue and its greatest fault. It must speak, and speak immediately, while the echoes of wonder, the claims of triumph and the signs of horror are still in the air.

Sounds to me like the knightmare and his henchmen realize their case is weak because they would have to agree to PTI rather than take that rock solid case to the jurors

She kept her plea not guilty the whole time right? I haven't seen anything about that changing yet

Either way, Knight gets the last laugh because when Plank refused to play his game, he had her arrested, first for a misdemeanor – and then when she continued refusing to play his ridiculous power-trip game, then he had her arrested for a felony. That’s the way the immoral game works. The bottom line is that Plank:

    • Refused to accept administrative sanctioning.
    • So Knight fired her and then had her arrested for a misdemeanor.
    • Then Plank hired an attorney (Andrea Mogensen) who publicly told the newspaper that the whole charade was politically motivated – which made Knight look bad in the press – which pissed him off even more, sooooo:
    • Knight then arranged his henchmen to have Plank arrested for a felony.

Right now, Knight still has the upper hand because there is no skin off his back, except that he might look like an idiot I the newspaper. So now Plank has to make a decision:

    • Accept the pre-trial plea deal or
    • Risk getting found guilty of a misdemeanor and a felony. Her guilt or innocence is moot in court because it’s predicated on who can present the best case to the jury.

Again, Knight gets the last laugh because he orchestrated all of this political crap – and there is no skin off his back. Plank bears all the risk because if she rejects the plea deal offer, then she could conceivably be reclassified as a convicted felon for the rest of her life – thanks to Knight’s underhanded dirty political wrangling. However, after the explosive fallout between the chief judge and Knight, have you noticed how Ed Brodsky is now distancing himself from Knight’s dirty politics? Prior to the fallout, Knight used to use the judiciary as his personal sword. However, Brodsky and the judges now fully understand Knight’s underhanded immoral vindictiveness. Knight ain’t kosher – and people know it.

Anyone who has even a half of a brain should be wondering why, after SIXTEEN MONTHS, did the state attorney allow this woman to do a pretrial intervention, just DAYS BEFORE THE START OF THE TRIAL! If this case was such a slam dunk, like they make it out to be, why wouldn’t the state attorney have been excited to go to trial and find her guilty? NEWS FLASH: because this is all smoke and mirrors!

This story has been loaded with lies, since the beginning, from Sheriff Tom Knight, who has proven again and again exactly how shady he is, and how he is not afraid to bend the rules to get what he wants. This woman submitted a not guilty plea in February of 2017 (over a year ago) and has maintained that plea every single day. This was not a plea deal. This woman did not take a deal. She was offered a PTI, while still maintaining her not guilty plea, for the last 16 months!

All of the reporting that has been done on this, since day one, has been completely one sided, with only what Sheriff Tom Knight has allowed to be released. All of the reports have painted this woman as a criminal, “according to Sheriff Tom Knight.” But do you really think, if she was truly guilty of these crimes, that the state attorney would allow her to participate in a PTI? Highly unlikely.

This is from the H-T comments section from one of our most outstanding former investigators:

    • "Brodsky pointed out the 'implicit bias' training his prosecutors receive, and he quoted his office’s mission statement: The Twelfth Judicial Circuit Office of the State Attorney is committed to ensuring that our community is protected by pursuing vigorous and fair prosecution of criminal offenders, by seeking justice, safeguarding the innocent and advocating for the rights of all victims. We will seek truth and justice in a professional manner, while maintaining the highest ethical standards. I am proud of the men and women who serve as prosecutors at the State Attorney’s Office, their diligence, their impartiality and their commitment to justice.”

    So what happened?

To accept PTI means she accepts a plea deal, which means she either pleads guilty or nolo contendre
