    Myopic view of mass shootings

    Everytime one of these things occur, gun control and mental health becomes the taking points. Metal detectors, more armed guards etc are called for. This is a myopic, feel good, response to a situation that cannot be completely eliminated in a free society. Having a mental health issue is not criminally illegal. Mental health records are fully protected, and are not provided to Leo. Social media providers are not obligated to cooperate with Leo, without court orders. Talking about violence without the ability to act etc, is fully protected by the first amendment. Being a loner, and not socially interactive, also is not a crime. How many times have we Baker Acted, or arrested somebody for a minor offense, that had such mental and or anger issues that you just knew it will be only a matter of time before they were going to be a future problem, but until they do, little to nothing can be legally done before hand. Even when we do Baker Act people, they all most never receive anything other than to be stabilized, and then they are released. Costs and legal rights against holding them are the issue. Law Enforcement efforts are based on violations of criminal law. We know many people that are suspects in various crimes, but until we meet the burden of probable cause, we have to wait to act. There are no provisions in place today, that would allow for detainment of people that are so defective that they are potentially dangerous to the public. Perhaps a separate system where mental health professionals can evaluate people not under criminal investigation, and can incarcerate them with periodic court review, indefinitely, until the mental health professionals feel comfortable allowing them back into the public. Of course there will be people that will never be released. Is our society willing to go this far if a crime has not occured?
